<br />Punch list form, which work shall be known as Punch List work. The Punch List shall be <br />signed by the City or its designee and the Contractor to confirm that the Punch List contains the <br />item(s) necessary to complete the Construction Work. The failure or refusal of the Contractor to <br />sign the Substantial Completion Inspection form or the Punch List, or the failure to include any <br />items of corrective work on such Punch List, do not alter the responsibility of Contractor to <br />complete all of the Work in accordance with the Contract Documents, <br /> <br />10.3 Where the Punch List is limited to minor omissions and defects, the City or its <br />designee shall indicate that the Construction Work is substantially complete subject to <br />completion of the Punch List. Where the City or its designee determines that the Work is not <br />substantially complete, the City or its designee shall provide a list of all open items necessary <br />to achieve Substantial Completion. Upon completion of such Work, the Contractor shall <br />request another Substantial Completion inspection. <br /> <br />10.4 The Contractor shall complete all remaining Work included in the Punch List within 14 <br />(fourteen) days of issuance of the Punch List. <br /> <br />10.5 Upon the receipt of all documentation, resolution of any outstanding issues and <br />completion of the Punch List items, the City or its designee shall issue a Final Certificate for <br />Payment. Upon issuance of the final payment, the City or its designee shall notify the Contractor <br />in writing of the closeout of the Project. <br /> <br />10.6 Warranties required by the Contract Documents shall commence on the date <br />of Final Completion of the Work or designated portion thereof unless otherwise provided in the <br />Certificate of Substantial Completion. <br /> <br />ARTICLE 11. WARRANTY OF CONSTRUCTION <br /> <br />The Contractor shall warrant that the Work conforms to the Agreement and is free of any patent <br />and/or latent defect of the workmanship for a minimum period of one year from the date of Final <br />Completion. This warranty shall be in addition to whatever rights the City may have under law. <br />The Contractor's obligation under this warranty shall be at its own cost and expense, to <br />promptly repair or replace (including cost of removal and installation), that item (or part <br />or component thereof) which proves defective or fails to comply with the Agreement within the <br />warranty period such that it complies with the Agreement. <br /> <br />ARTICLE 12. AS-BUILT DRAWINGS <br /> <br />During the Construction Work, Contractor shall maintain records of all deviations from <br />the Drawings and Specifications as approved by the City or its designee and furnish such <br />information as is required for the City or its designee to prepare As-Built Record Drawings <br />showing correctly and accurately all changes and deviations made during construction to <br />reflect the work as it was actually constructed. <br /> <br />HISTORIC SUNNY ISLES BEACHlNEWPORT FISHING PIER AT PIER PARK <br /> <br />r' <br /> <br />." <br />
