<br />3.2.12 The Contractor shall be responsible to the City for acts and omissions of the Contractor's <br />employees, Subcontractors of any tier and their agents and employees, and any entity or other <br />persons performing portions of the Work. <br /> <br />3.2.13 The Contractor shall not be relieved of its obligations to perform the Work in accordance <br />with the Contract Documents either by activities or duties of the City's Representative or NE in <br />their administration of the Contract, or by tests, inspections or approvals required or performed <br />by persons other than the Contractor. <br /> <br />3.2.14 The Contractor shall be responsible for inspection of portions of the Work already <br />performed under this Contract to determine that such portions are in proper condition to receive <br />subsequent Work. <br /> <br />3.2.15 Job site safety is the responsibility of the Contractor. Any costs associated with providing <br />a safe construction site, including staging areas, per all State, Federal, City and OSHA <br />regulations are included in the bid price submitted. <br /> <br />The Contractor shall take all reasonable precautions for the safety of, and shall provide all <br />reasonable protection to prevent damage, injury or loss to: <br /> <br />1. all employees on the Work and all other persons who may be affected thereby; <br /> <br />2. all the Work and all materials and equipment to be incorporated therein, whether in <br />storage on or off the site, under the care, custody or control of the Contractor or any of his <br />Subcontractors or Sub subcontractors, machinery, equipment and all hazards shall be guarded <br />or eliminated in accordance with all applicable safety regulations; and <br /> <br />3. other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, <br />pavements, roadways, structures and utilities not designated for removal, relocation or <br />replacement in the course of construction. <br /> <br />3.3 Use of Site <br /> <br />3.3.1 The Contractor shall limit operations and storage of material to the area within the Work <br />limit lines shown on Drawings, except as necessary to connect to exiting utilities, shall not <br />encroach on neighboring property, and shall exercise caution to prevent damage to existing <br />structures. <br /> <br />3.3.2 Only materials and equipment, which are to be used directly in the Work, shall be brought <br />to and stored on the Work site by the Contractor. After equipment is no longer required for the <br />Work, it shall be promptly removed from the Work site. Protection of construction materials and <br />equipment stored at the Work site from weather, theft, damage and all other adversity is solely <br />the responsibility of the Contractor. <br /> <br />3.3.3 No project signs shall be erected without the written approval of the City's Representative. <br /> <br />l..
