<br />PROVISION 4 <br />ADMINISTRATION OF THE CONTRACT <br /> <br />4.1 Rights of the City <br /> <br />4.1.1 The City's Representative will administer the Construction Contract. The AlE will assist <br />the City's Representative with the administration of the Contract as indicated in these Contract <br />Documents. <br /> <br />4.1.2 If, in the judgment of the City's Representative, it becomes necessary to accelerate the <br />work, the Contractor, when directed by the City's Representative in writing, shall cease work at <br />any point and transfer its workers to such point or points and execute such portions of the work <br />as may be required to enable others to hasten and properly engage and carry out the work, all as <br />directed by the City's Representative. The additional cost of accelerating the work, if any, will be <br />borne by the City, unless the Contractor's work progress is behind schedule as shown on the most <br />recent progress schedule. <br /> <br />4.1.3 The City's Representative, may, by written notice, require a Contractor to remove from <br />involvement with the Work, any of Contractor's personnel or the personnel of its Subcontractors <br />of any tier whom the City's Representative may deem abusive, incompetent, careless, or a <br />hindrance to proper and timely execution of the Work. The Contractor shall comply with such <br />notice promptly, but without detriment to the Work or its progress. <br /> <br />4.1.4 The City's Representative will schedule Work status meetings that shall be attended by <br />representatives of the Contractor and appropriate Subcontractors of any tier. Material suppliers <br />shall attend status meetings if required by the City's Representative. <br /> <br />4.2 Review of the Work <br /> <br />4.2.1 The NE and the City's Representative shall, at all times, have access to the Work; and the <br />Contractor shall provide proper and safe facilities for such access. <br /> <br />4.2.2 The City's Representative shall have authority to reject Work that does not strictly comply <br />with the requirements of the Contract Documents. Whenever the City's Representative <br />considers it necessary or advisable for implementation of the intent of the Contract Documents, <br />City's Representative shall have the authority to require additional inspection or testing of the <br />Work, whether or not such Work is fabricated, installed or completed. <br /> <br />4.2.3 The fact that the AlE or the City's Representative observed, or failed to observe, faulty <br />Work, or Work done which is not in accordance with the Contract Documents, regardless of <br />whether or not the City has released final payment, shall not relieve the Contractor from <br />responsibility for all damages and additional costs of the City as a result of defective or faulty <br />Work. <br /> <br />20 <br />
