the CONTRACTOR shall notify the CITY immediately. Lack of such notice to the CITY will be construed as <br />acceptance by the CONTRACTOR of the status of the Work of other CONTRACTORS as being satisfactory for proper <br />coordination of their own Work. <br />7.9 The cost of extra Work resulting from lack of notices, untimely notices, failure to respond to notices, defective <br />Work or lack of coordination shall be borne by the CONTRACTOR responsible for such lack of notices, etc. <br />ARTICLE 8 - CITY'S RESPONSIBILITIES <br />8.1 The CITY will issue all communications to the CONTRACTOR. <br />8.2 The CITY will furnish the data required of them under the Contract Documents promptly. <br />8.3 The CITY'S duties in respect to providing lands and easements are set forth in Paragraphs 4.1 and 4.2. <br />8.4 The CITY shall have the right to take possession of and use any completed or partially completed portions of the <br />Work, notwithstanding the fact that the time for completing the entire Work or any portion thereof may not have expired; <br />but such taking possession and use shall not be deemed an acceptance of any Work not completed in accordance with <br />the Contract Documents. <br />ARTICLE 9 - CITY'S STATUS DURING CONSTRUCTION <br />Measurement of Quantities: <br />9.1 All Work completed under the Contract will be measured by the CITY according to the United States Standard <br />Measures. All linear surface measurements will be made horizontally or vertically as required by the item measured. <br />Reiectine Defective Work: <br />9.2 The CITY will have authority to disapprove or reject Work which is "defective" (which term is hereinafter used <br />to describe Work that is unsatisfactory, faulty or defective, or does not conform to the requirements of the Contract <br />Documents or does not meet the requirements of any inspection, test or approval referred to in Special Condition, or has <br />been damaged prior to final acceptance). They will also have authority to require special inspection or testing of the <br />Work as provided in the Special Conditions whether or not the Work is fabricated, installed or completed. <br />Shop Drawings, Change Orders and Payments: <br />9.3 In connection with the CITY'S responsibility as to Shop Drawings and samples, see paragraphs 6.25 through 6.28, <br />inclusive. <br />9.4 In connection with the CITY'S responsibility for Change Orders, see Articles 10, 11, and 12. <br />9.5 In connection with the CITY'S responsibilities in respect of Application of Payment, etc., see Article 14. <br />Resident Proiect Representative: <br />9.6 The CITY will provide construction observation sufficient to confirm to CITY and all applicable regulatory <br />agencies that construction is in compliance with the Construction Drawings and the Contract Specifications. <br />Decisions on Disagreements: <br />00710- 16 <br />
