1 <br />fj <br />1 <br />u <br />accuracy or reliability of such information guaranteed. It shall be the <br />responsibility of the CONTRACTOR to determine the accurate identity and <br />location of any such manufacturer, distributor, or other source of any <br />product or material called for in the Contract Documents. <br />C. The CONTRACTOR may offer any material, process, or equipment, which <br />it considers equivalent to that, indicated. Unless otherwise authorized in <br />writing by the ENGINEER, the substantiation of offers of equivalency must <br />be submitted within 30 days after execution of the Agreement. The <br />CONTRACTOR, at its sole expense, shall furnish data concerning items it <br />has offered as equivalent to those specified. The CONTRACTOR shall <br />have the material as required by the ENGINEER to determine that the <br />quality, strength, physical, chemical, or other characteristics, including <br />durability, finish, efficiency, dimensions, service, and suitability are such <br />that the items will fulfill its intended function. Installation and use of a <br />substitute item shall not be made until accepted by the ENGINEER. If a <br />substitute offered by the CONTRACTOR is found to be not equal to the <br />specified material, the CONTRACTOR shall furnish and install the <br />specified material. <br />D. The CONTRACTOR'S attention is further directed to the requirement that <br />failure to submit data substantiating a request for the substitution of an "or <br />equal" item within said 30 -day period after the execution of the <br />Agreement, shall be deemed to mean that the CONTRACTOR intends to <br />furnish one of the specific brand -named products named in the <br />specification, and the CONTRACTOR does hereby waive all rights to offer <br />or use substitute products in each such case. Wherever a proposed <br />substitute product has not been submitted within said 30 -day period, or <br />wherever the submission of a proposed substitute product fails to meet the <br />requirements of the specifications and an acceptable resubmittal is not <br />received by the ENGINEER within said 30 -day period, the CONTRACTOR <br />shall furnish only one of the products originally -named in the Contract <br />Documents. <br />1.04 ABBREVIATION <br />A. Wherever in these specifications references are made to the standards, <br />specifications, or other published data of the various national, regional, or <br />local organizations, such organizations may be referred to by their <br />acronyms or abbreviation only.
