<br />I <br /> <br />RESOLUTION NO. 2011- ~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING <br />CHANGE ORDER NO.5 TO AGREEMENT WITH TENEX <br />ENTERPRISES FOR ADDITIONAL SIDEWALK WORK, <br />IN AN AMOUNT NOT TO EXCEED THIRTY THOUSAND <br />NINE HUNDRED NINETY -FOUR DOLLARS AND <br />TWENTY CENTS ($30,994.20), A TT ACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission has long desired to have a consistent <br />streetscape theme along Collins A venue. <br /> <br />WHEREAS, on October 29,2009 via Resolution No. 2009-1495 the City entered <br />into an agreement with Tenex Enterprises for construction of the 183rd Street streetscape <br />improvement and 175th Street median closing for an amount not to exceed Four Hundred <br />Eighty Seven Thousand Six Hundred Thirty-Four Dollars ($487,634.00); and <br /> <br />WHEREAS, on April 15, 2010 via Resolution No. 2010-1551 amended the <br />agreement with Tenex Enterprises for the construction of the 183rd Street streetscape <br />improvement and 175th Street median contract closing for additional services in an <br />amount not to exceed Seventy-Five Thousand Six Hundred Sixty-Eight Dollars and <br />Seventy-Five Cents ($75,668.75); and <br /> <br />WHEREAS, on June 17, 2010 via Resolution No. 2010-1573 amended the <br />agreement with Tenex Enterprises for the construction of the 183rd Street streetscape <br />improvement and 175th Street median closing for extension of the paver sidewalk from <br />172 Street to 163 Street in an amount not to exceed One Hundred Twenty-Five Thousand <br />Dollars and ($125,000); and <br /> <br />WHEREAS, on July 15, 2010 via Resolution No. 2010-1586 amended the <br />agreement with Tenex Enterprises for additional up-lighting of Mejool Palms, street pole <br />lights, driveway modifications, additional median modifications, additional electrical and <br />telephone work and conduits, replacement of water meter boxes, and relocation and repair <br />of irrigation in an amount not to exceed Sixty-Five Thousand One Hundred Sixty Dollars <br />and Forty-Five Cents ($65,160.45); and <br /> <br />WHEREAS, Tenex Enterprises has submitted to the City the cost for additional <br />sidewalk work along the west side of Collins A venue between Oceania Condominium and <br />Atlantic Isles entrance in an amount not to exceed Thirty Thousand Nine Hundred Ninety- <br />Four Dollars and Twenty Cents ($30,994.20); and <br />
