Summary Minutes: Regular City Commission Meeting

July 20, 2006

City of Sunny Isles Beach, Florida

strongly recommends and agrees that Mr. Price is correct in terms ofthe law.

Commissioner Iglesias said he looked at Sunny Isles Beach as a high-rise and Golden Beach is
not, but north of Golden Beach is Hallandale Beach which is high-rise, to the west you have
A ventura, a high-rise, Bal Harbour south of us is high-rise, Surfside has high-rise, Miami
Beach on the Ocean. He said four years ago when he was doing the beautification grants, at
the time, Golden Beach Mayor Judy Quenca said that they were going after the beautification
grant because that City although they have very nice prestigious homes, was not really that
rich. He said the bottom line is what we are doing here is in character of what we are doing in
our City and most of the surrounding cities in northeast Dade, which as Stanley Price said,
was acknowledged by Dade County as a high-density area. Vice Mayor Brezin said she
respects the opinion of City Attorney Ottinot and she agreed with Commissioner Iglesias.
Commissioner Thaler said that he thinks the building is a beautiful building and fits very well
within Sunny Isles Beach, and is one of the better buildings in Sunny Isles Beach, it has very
few apartments, therefore not a lot oftraffic will be going in and out of the building and it will
be a very expensive building therefore helping our income process within Sunny Isles Beach.
Commissioner Goodman said he was happy about the beach accesses, and that the building is
magnificent, 40-stories with only 40-apartments.

Mayor Edelcup said three years ago when this project came before him and he was Vice
Mayor at the time, he noted at that time that this was one ofthe finest kind of buildings to be
built in Sunny Isles Beach because it didn't maximize what could be done, in fact it
minimized in many cases of what could be done, and he complimented the builder at the time,
that he was doing a great service to our City taking into account that he could have tripled the
number of units, increase the density, and created a higher traffic flow then what 40
apartments have vs. 120 which could be built in this area. He said the citizens of Sunny Isles
Beach, for the majority, are very pleased with this project. He said he finds it amusing that he
had an informal meeting with the Mayor of Golden Beach a year or so ago when that Mayor
approached him that maybe he would be interested in deeding that property over to Golden
Beach so that they could enjoy the tax benefits of having that property in their City. Mayor
Edelcup said he told him no but if Golden Beach wanted to become part of Sunny Isles Beach
that we would maybe contemplate taking Golden Beach into Sunny Isles Beach. He said this
is a beautiful project, one of the better kinds that can be built in Sunny Isles Beach and he
looks forward to seeing it happen.

Commissioner Iglesias moved and Vice Mayor Brezin seconded a motion for approval as
amended, subject to staff conditions. City Attorney Ottinot said for the record that it is
adopted with the conditions, and repealing Resolution No. 2006-890 as set forth in the
Resolution. Resolution No. 06-Z-102 was approved by a roll call vote of 5-0 in favor.
Vote: Commissioner Goodman yes
Commissioner Iglesias yes
Commissioner Thaler yes
Vice Mayor Brezin yes
Mayor Edelcup yes

[City Clerk's Note: Exhibits 1-16 labeled and incorporated into record. Afive-minute
recess was taken after this item.]

13
