<br />'} <br /> <br />ATTACIiMENT A. EMPLOYMENT PREFERENCE FOR <br />APPALACIiIAN CONTRACTS <br />(Applicablelo Appalachian contracts only.) <br />1. During the perfonnance ollhis contract, the contractor under- <br />taking to do work which is, or reasonably may be, done as on-sile <br />work. shall give preference to Qualified persons who regularly reside <br />in the labor area as designated by the DOL wherein lhe contract work <br />is siluated, or the subregion, or (he Appalachian counties of the State <br />wherein (he contracl work is situated, except: <br />3. To the extent that qualified persons regularly residing in <br />the area are no' available. <br /> <br />b. For the reasonable needs of the contractor 10 employ <br />supervisory or specially experienced personnel necessary 10 assure <br />an efficient execution of the contract work. <br />c. For the obligation 01 the contractor to offer employment to <br />b~~~:~i'; ~~:~.~~eede:h~~h~~U~b~~tot~~n~::u~n~~~~~: <br />employed under this subparagraph 1c shall not exceed 20 percent of <br />Che lolal number of employees employed by the contraclor on (he <br />contracl work, except as provided in subparagraph 4 below. <br />2. The contractor shall place a job order with lhe State Employ- <br />ment Service indicating (a) lhe classifications of the laborers, <br />:o~~(~~~:~~~~~rJ~~~ro~~;~~~~~~dl?n ~~~~~a~~~r~~~~,ct <br /> <br />(c) the dale on which he eslimates such employees win be required, <br />and (d) any other pertinent informalion required by the Stale Employ- <br />ment SeMCe to complete the job order form. The;ob order may be <br />placed with the Slale Employment Service in writing or by telephone. <br />If during the course of the contract work, the information submitted by <br />the contractor in the original job order is substantially modified, he <br />shall promplly nolily the State Employmenl Service. <br />3. The contractor shall give full consideration to all qualified job <br />appliesnlS referred to him by Ihe Stale Employment Service. The <br />contractor is not required 10 grant employment to any job applicants <br />who, in his opinion, are not qualified to pertorm the classiflC8tion of <br />work required. <br />4. If, within 1 week following Ihe placing of a job order by the <br />contraclorwith the Stale Employment Service, the State Employmenl <br />Service is unable fa refer any qualified job applicants 10 the contrac- <br />tor, or less than Ihe number requested, the Slale Employmenl <br />Service will forward a certificale to the contractor indicating the <br />unavailabi~ly of applicants. Such certifICate shaJI be made a part of <br />(he contractor's permanent project records. Upon receipl of this <br />cer1ificate. the contractor may employ persons who do not normally <br />reside in the labor area 10 flU positions covered by the certificate, <br />notwithstanding Ihe provisions of subparagraph 1c above. <br />5.
