<br />5.14.3.3 <br /> <br />Employers' Non-Ownership. <br /> <br />5.14.4. Before starting the Work, the Contractor will file and make sure that all certificates of insurance <br />required by this document and by the Contract are in the City's possession. These certificates <br />shall contain a provision that the coverage afforded under the policies will not be canceled or <br />materially changed until at least thirty (30) days prior written notice has been given to the City <br />by certified mail. The City shall be named as an additional insured on the above-referenced <br />policies. <br /> <br />5.14.5. The Contractor agrees that if any part of the Work under the Contract is sublet, they will require <br />the Sub-Contractor(s) to carry insurance as required, and that they will require the Sub- <br />Contractor(s) to furnish to them insurance certificates similar to those required by the City in <br />this section. <br /> <br />5.15. Cancellation and Re-Insurance: If any insurance should be canceled or changed by the <br />insurance company or should any insurance expire during the period of this contract, the Contractor shall <br />be responsible for securing other acceptable insurance to provide the coverage specified in this section to <br />maintain coverage during the life of this Contract. All deductibles must be declared by the Contractor <br />and must be approved by the City. At the option of the City, either the Contractor shall eliminate or <br />reduce such deductible or the Contractor shall procure a Bond, in a form satisfactory to the City, covering <br />the same. <br /> <br />5.16. Contractor's Responsibility: The Contractor shall have the following responsibilities: <br /> <br />5.16.1.Supervision and Superintendence: The Contractor will supervise and direct the Work. They <br />will be solely responsible for the means, methods, techniques, sequences and procedures of <br />construction. The Contractor will employ and maintain a qualified supervisor or superintendent at <br />the Work site who shall be designated in writing by the Contractor as the Contractor's <br />representative at the site. The supervisor shall have full authority to act on behalf of the <br />Contractor and all communications given to the supervisor shall be as binding as if given to the <br />Contractor. The supervisors shall be present at each site at all times as required to perform <br />adequate supervision and coordination of the Work. (Copies of written communications given to <br />the Superintendent shall be mailed to the Contractor's home office). <br /> <br />5.16.2. Labor, Materials and Equipment: The Contractor will provide competent, suitably qualified <br />personnel to layout the Work and perform construction as required by the Contract Documents. <br />They will at all times maintain good discipline and order at the site. <br /> <br />5.16.3. The Contractor will furnish all materials, equipment, labor, transportation, construction <br />equipment and machinery, tools, appliances, fuel, power, light, heat, local telephone, water and <br />sanitary facilities and all other facilities and incidentals necessary for the execution, testing, <br />initial operation and completion of the Work. <br /> <br />5.16.4.AII materials and equipment will be new, except as otherwise provided in the Contract <br />Documents. When special makes or grades of material which are normally packaged by the <br />supplier or manufacturer are specified or approved, such materials shall be delivered to the site <br />in their original packages or containers with seals unbroken and labels intact. <br /> <br />5.16.5. All materials and equipment shall be applied, installed, connected, erected, used, cleaned and <br />conditioned in accordance with the instructions of the applicable manufacturer, fabricator, or <br />processors, except as otherwise provided in the Contract Documents. <br /> <br />5. 16.6.Materials, Equipment, Products and Substitutions: Materials, equipment and products <br /> <br />PAGE 17 OF 130 <br />BID No. 08-10-01 <br />
