A Florida corporation that provides unarmed security guard <br />servIces. <br /> <br />9.19 NONE <br /> <br />9.20 NONE <br /> <br />9.21 <br /> <br />LITIGATION HISTORY <br /> <br />· A 2004 Contract to provide event cleaning services to the City of Miami's Orange <br />Bowl Stadium, Bayfront Park and Coconut Grove Convention Center was awarded <br />to SFM Services, Inc. At that time the Federal Minimum Wage was $5.15 per hour <br />and the SFM's billing rate to the City was $9.90 per hour. <br /> <br />· On April 29, 2005, the State of Florida Minimum Wage went into effect and <br />SFM's hourly pay rate was raised accordingly from $5.15 per hour to $6.15 per <br />hour. The City of Miami purchasing department raised SFM's billing rate to the <br />City to $11.13 per hour to accommodate the increase in SFM's hourly pay rate to <br />its staff. <br /> <br />· In October 2006, the City of Miami passed an ordinance to pay "living wages" of <br />$11.83 per hour. SFM's staff anticipated this pay rate, and asked Glenn Marcos, <br />City of Miami's Procurement Director about paying living wages, and he indicated <br />that it did not apply to SFM's contract since it pre-dated the living wage ordinance. <br />This question was presented to Mr. Marco's a second time due to pressure from <br />our staff and the same answer was given as before: "no, it does not apply since <br />your contract was executed before the living wage ordinance and living wage <br />ordinance only applies to contracts executed after 10-01-06," <br /> <br />· A class action lawsuit ensued against SFM Services, Inc. represented by Jose <br />Rodriguez, Esquire on behalf of our employees and Florida Legal Services, Inc. <br />On advice of my attorney, George McArdle, we joined the City of Miami as a third <br />party defendant. <br /> <br />· A subsequent meeting was held in Glenn Marco's office with my attorney present <br />and Glenn admitted to having made the mistake of relying on a copy of the first <br />reading of the living wage ordinance and that on the 2nd reading someone added <br />the words "and to include contract renewals". <br />
