<br />Survey for 18500 Collins Avenue as prepared by James Beadman and Associates Inc. <br />consisting one sheet, all stamped received on March 11, 2011. <br /> <br />(3) That the Applicant comply with all conditions and permit requirements of the Department <br />of Environmental Resource and Management (DERM), the Miami-Dade County Fire <br />Department (MDFD), Water and Sewer Department, Department of Environmental <br />Protection (DEP), Florida Department of Transportation (FDOT). <br /> <br />(4) That the Applicant obtains a Business License and a Certificate of Use from the City upon <br />compliance with all terms and conditions. The Business License and Certificate of Use <br />shall be subject to cancellation upon violation of any conditions. <br /> <br />(5) That the sale of distilled liquor will only be permitted during the store operation hours as <br />outlined under Chapter 98 of the City Code whichever is more restrictive. <br /> <br />(6) That the approval of this conditional use requires that the parking lot lights remain on <br />from dawn to dusk following the standard daylight and saving time guidelines. <br /> <br />(7) That the Applicant shall provide payment of $25,000 for mitigation purposes to the City <br />for its recreational programs and school. <br /> <br />(8) That the Applicant shall negotiate a surplus parking agreement for a minimum of ten (10) <br />parking spaces with the owner of the property located on the west side of the Applicant's <br />property. If Applicant is unable to workout a surplus parking agreement with the <br />aforementioned property owner, the Applicant agrees to workout a surplus parking with <br />the City to use public parking space for employees of the Applicant. <br /> <br />(9) That the Applicant shall submit to the City a landscape plan for improving the existing <br />landscape. Upon approval of the Landscape Plan, the Applicant shall make all necessary <br />improvements no less than 30 days from the date of this Resolution. <br /> <br />FAILURE BY THE CITY TO TIMELY ENFORCE ANY OF THE ABOVE <br />CONDITIONS DOES NOT CONSTITUTE A WAIVER OF THE SAME AND IF THE <br />APPLICANT, ITS SUCCESSORS, OR, ASSIGNS, DOES NOT PERFORM SUCH <br />CONDITIONS WITHIN FIVE (5) DAYS AFTER WRITTEN NOTICE, THE CITY <br />RETAINS THE RIGHT TO REVOKE THE CONDITIONAL USE APPLCIATION, IF <br />NECESSARY, UNTIL THAT CONDITION IS MET. BY ACTING UNDER THIS <br />APPROVAL, APPLICANT HEREBY CONSENTS TO ALL THESE TERMS AND <br />CONDITIONS. <br /> <br />V. SEVERABILITY AND EFFECTIVE DATE. <br /> <br />(1) If any section, subsection, clause of provision of this Resolution is held invalid, the <br />remainder shall not be affected by such invalidity.
