<br />RESOLUTION NO. 2011-l1.J.5 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING <br />THE PURCHASE OF EIGHTY (80) DECORATIVE LITTER <br />CONT AINERS FROM TOTER INCORPORATED, <br />PURSUANT TO A NATIONAL I.T.A. AGREEMENT <br />THROUGH THE CITY OF TUCSON 083008-01, IN AN <br />AMOUNT NOT TO EXCEED TWENTY -EIGHT <br />THOUSAND SEVEN HUNDRED TWENTY -EIGHT <br />DOLLARS ($28,728.00), A TT ACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission has expressed a desire to replace the current litter <br />containers along the beach area with containers that are more decorative and conducive to the <br />City's Streetscape Plan; and <br /> <br />WHEREAS, Toter Incorporated is the sole source vendor of decorative litter container <br />Model 860SB; and <br /> <br />WHEREAS, Toter has provided a quote for the purchase of eighty (80) decorative litter <br />containers in a total amount not to exceed Twenty-Eight Thousand Seven Hundred Twenty-Eight <br />Dollars ($28,728.00), attached hereto as Exhibit "A"; and <br /> <br />WHEREAS, the quote from Toter utilizes the same pricing, terms, and conditions as <br />City of Tucson Agreement 083008-01; and <br /> <br />WHEREAS, the City's procurement codes provides that purchases made under state, <br />county or other governmental contracts, or competitive bids with other governmental agencies are <br />exempt from the City's competitive bidding procedures; and <br /> <br />WHEREAS, the City desires to purchase said decorative litter containers from Tolar. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Ratification of Purchase. The City Commission hereby ratifies the purchase of <br />eighty (80) decorative litter containers from Toter Incorporated, in a total amount not to exceed <br />Twenty-Eight Thousand Seven Hundred Twenty-Eight Dollars ($28,728.00), as quoted and <br />attached hereto as Exhibit "A", pursuant to City of Tucson Agreement 083008-01. <br /> <br />Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate this Resolution. <br /> <br />Section 3. <br /> <br />Effective Date.
