<br />Section 2 <br />Special Terms and Conditions <br /> <br />2.1 PURPOSE OF PROPOSAL: <br /> <br />The City of Sunny Isles Beach, Florida, (the "City'') a municipality located in Miami-Dade County, <br />Florida, requests qualified Proposers ("Proposers'') to submit proposals for the design, fabrication, <br />and installation of canopy structures to be installed at Heritage Park (19200 Collins Avenue, <br />Sunny Isles Beach Florida) and Golden Shores Park (191 Terr. and Atlantic Blvd.). <br /> <br />2.2 PRE-PROPOSAL CONFERENCE: <br /> <br />Intentionally Omitted <br /> <br />2.3 TERM <br /> <br />This contract shall commence upon the date of the Notice to PROCEED and shall remain in effect <br />until such time as the commodities, equipment and/or services acquired in conjunction with this <br />Request for Proposal have been completed and accepted by the City's authorized representative <br />and upon completion of the expressed and/or implied warranty periods. <br /> <br />2.4 OPTIONS TO RENEW <br /> <br />Intentionally Omitted <br /> <br />2.5 PRICE <br /> <br />If the proposer is awarded a contract under this solicitation, the prices proposed by the proposer <br />shall remain fixed and firm during the term of contract and shall be inclusive of all necessary <br />tasks and services to provide the City with a 100% acceptable product. <br /> <br />2.6 PERFORMANCE AND PAYMENT BOND <br /> <br />The City of Sunny Isles Beach shall require the successful Proposer to furnish a Performance and <br />Payment Bond in the amount of 100% of the total Proposal Price, with the City of Sunny Isles <br />Beach as the Obligee, as security for the faithful performance of the Contract and for the <br />payment of all persons performing labor or furnishing materials in connection herewith within ten <br />(10) calendar days after notification of the award by the City. The bonds shall be with a surety <br />company authorized to do business in the State of Florida. <br /> <br />2.7 BID BOND <br /> <br />The City of Sunny Isles Beach shall require that every Proposer furnish a Bid Bond in the amount <br />of 5% of the total Proposal Price. <br /> <br />2.8 DELIVERY <br /> <br />Intentionally Omitted <br /> <br />2.9 INSURANCE <br /> <br />Comprehensive General Liability with minimum limits of Two Million Dollars ($2,000,000.00) per <br />occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. <br /> <br />PAGE 12 OF 33 <br />BID No. 11-10-01 <br />
