LDRs ORDINANCE FOR FIRST READING <br />An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, <br />Establishing Procedures for the Issuance of Development Permits by the City of Sunny <br />Isles Beach for the Development of Land Within the City; Providing for Purpose and <br />Definitions; Providing for Development Review Requirements; Providing for Vested Rights; <br />Providing for Procedures to Amend the Comprehensive Plan and Land Development <br />Regulations; Providing for Platting Procedures; Providing for Site Plan Procedures and <br />Requirements; Providing for Procedures for the Issuance of Permanent or Temporary <br />Certificates of Occupancy; Providing for Zoning Districts; Providing for Parking <br />Requirements; Providing for Sign Regulations; Providing for Landscaping Requirements; <br />Providing for Development Standards; Providing for Regulations of Nonconforming Uses <br />and Structures; Providing for Performance Standards; Providing for Appeal; Providing for <br />Repeal of Certain Portions of Chapter 33 of the Code of Miami-Dade County as Made <br />Applicable to the City Pursuant to Article 8.3 of the City Charter; Providing for Repeal of <br />Conflicting Provisions; Providing for Severability; Providing for Inclusion in the Code, and <br />Providing for an Effective Date. <br />(Scheduled on 11/14/02) <br /> <br />Action: [City Clerk's Note: Revised Sections a/the LDRs were distributed) City Clerk <br />Brown-Morilla read the title and Shelley Eichner, City Planning Consultant, and Vice <br />President of Calvin Giordano and Association, summarized the last Workshop of November <br />7, 2002, and announced what revisions were made since that Workshop. Deputy City <br />Attorney Hans Ottinot reported. <br /> <br />Mayor Samson announced that he would be requesting to exclude the B-2 and B-2A Zoning <br />Districts from the proposal. Subsequently Mayor Samson passed the gavel and then moved, <br />and Commissioner Goodman seconded a motion to exclude B-2 and B-2A. The motion to <br />exclude the B-2 and B-2A Zoning Districts from the proposal was approved by a voice <br />vote of5-0 in favor. Diana Grub-Frieser clarified that the Mayor's motion would leave the <br />existing Zoning for B-2 and B-2A in place. <br /> <br />Public Speakers: Shelly Eichner; Jorge Vera; Diana Grub- Frieser, Esq.; Janna Lhota, Esq.; <br />Tucker Gibbs, Esq.; Don Chinquina, Esq.; Stanley Price, Esq.; Cliff Schulman, Esq.; Gene <br />Sweed; Mary Ann Eicke; Arnold Taft; Paul Rongved; James Ippolito; Delia Mirabal; Glen <br />Gemski; Hassida (Cassey) Gabor; Henry Kay <br /> <br />Commissioner Iglesias requested changes to allow staff approval of site plan review. Mayor <br />Samson objected. Ms. Grub-Frieser clarified the prior intent of the City Commission which <br />had resulted in the LDRs being written so that staff would not have administrative discretion. <br />There was no consensus to support Commissioner Iglesias's proposal. <br /> <br />There was a majority of consensus in support of the concern expressed by Commissioner <br />Iglesias regarding parking space width. The proposal will be re-drafted to provide for 8 Y2- <br />feet width for parking spaces for residential parking and leave it at 9- feet width for <br />publiclcommercial parking spaces. <br /> <br />2 <br />
