Commissioner Thaler asked if they are planning on committing
within the next month on the TDRs, when are you planning on coming before the
Commission to exercise their rights on the TDRs? Mr. Defortuna said that they have to
do it by the time they pull the building permit, that it depends on the architects and when
the construction drawings are finally done, and they are ready to go. He said the building
is basically sold, and the financing is there, they are just waiting on the final drawings and
the City to approve it, and in the meantime, he will come before the Commission in a
month with the proposals. He said the approved site plan under Resolution No.
03-Z-78, be subject to the plans that are submitted before the Commission, however, there
were changes to the parking layout on those plans, and that change is not approved at this
time.

City Attorney Dannheisser clarified that the motion is on the cabanas not withstanding the
fact that we have site plans that reflect the difference in the garage, the Commission is
only approving the cabanas at this time.

Commissioner Iglesias moved and Commissioner Brezin seconded a motion for
approval for the cabanas only, subject to staff conditions.
