Vice Mayor
Goodman said he understands that if Mr. Katz accepts the agreement then that is the end
of it but if he does not sign the agreement, then we go back to eminent domain.

City Attorney Dannheisser clarified that what is coming back is not the acceptance of the
agreement, the offer that was put forth by this Commission, and Mayor Ede1cup said they
will either accept it or reject it. Commissioner Thaler understood that if it is not signed
by the 6th it will go back to eminent domain. City Attorney Dannheisser said that this is a
new agreement that he will be signing which will be brought back to the Commission, it
is not the offer that was made. City Attorney Dannheisser asked if we are calling a
meeting on the 6th to consider the revised agreement if there is one, and Mayor Edelcup
said yes. City Attorney Dannheisser said that the Commission can also consider if he
signs the revised agreement, to defer action until the regular meeting on April 15, 2004,
and the Commission agreed.

7.
