Summary Minutes: Regular City Commission Meeting January 15,2004

City of Sunny Isles Beach, Florida

Certain Conditions; Providing for an Effective Date. (Z2003-15 - Jade on the Beach)
(Continued from 12/18/03)

Action: City Clerk Hines read the title and City Attorney Dannheisser noted that the
Zoning application for a Sales Office was approved on December 18, 2003, and that the
resolution is coming back for final adoption with several conditions. She reminded the
Commission that there was an issue as to the height, which the Commission set at 30-feet,
with a 10-foot landscape buffer. City Attorney Dannheisser stated that today she received
a revision from the Attorney for the Jade Sales Center wishing to add some language that
she felt would adjust the height of the building to allow for the wings and the air
conditioning structure.

Public Speakers: Judith Burke, Esq.; Kobi Karp, Architect; Henry Kay

Judith Burke, Esq., representing Fortune Beach, LLC, said the issue with the resolution
was that it mentioned that the Sales Center would be 30-feet at the roof which is exactly
what it is, but she wants to change the description of the plans because it didn't have the
last revised date of 12-18-03, which were the plans that she submitted to the Commission
at that public hearing. She noted that the architectural features are on top of the 30-foot
roof, and wanted to add the language that the plans were dated November 13, 2003, last
revised December 18, 2003 as accepted by the Commission at the hearing.
Commissioner Thaler asked if the overall height is 30-feet, and Ms. Burke said no, the
roof is 30-feet.

Kobi Karp, Architect for the project, noted that the roof height is 30-feet, and the wings
provides the elevator for the project, and the highest point with the wings is 60-feet. He
stated that the elevator is in the middle, and to hide the elevator machine room and air
conditioning units with a covering, the fins of the building come up at 50-feet.
Commissioner Thaler said that at the last meeting it was stated that the Architect was
going to take the building down to 30-feet in total. Mr. Karp noted that the roof was
originally 50-feet and they brought it down to 30-feet, and Ms. Burke said that it was
presented at the last public hearing and approved by this Commission. Mayor Ede1cup
said that there is confusion because this Commission thought the overall height was 30-
feet. Ms. Burke said that it was 50-feet and they brought it down to 30-feet, moved it
back 25-feet setback away from the street, and they agreed to put in the lO-foot buffer.
Commissioner Brezin asked how many feet in width is that elevator shaft, and Mr. Karp
presented a rendering of the Sales Center.

Commissioner Iglesias noted that at the last meeting it was agreed that the City will get
the Sales Center for use in a future park, or as a recreational center, etc., and Ms. Burke
answered yes, if you can move it, you can have it. Commissioner Iglesias said he would
like to see it built in sections. Mr. Karp said he spoke to Ron Korneig and they would be
able to do that. Vice Mayor Goodman said there should be a time limit as to how long
the building is going to stay there and in the event that the project doesn't sell, is the City

3
