<br />Summary Minutes: Regular City Commission Meeting <br /> <br />May 18, 2006 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />Commissioner Goodman said what Building Official Parker did tonight with his presentation <br />was interesting to the public and all the people living in Sunny Isles Beach has been having <br />difficulty with Code Enforcement repairs, etc. Commissioner Iglesias said advertising would <br />maybe generate something for programming itself like Channel 2 for example, the Sunny <br />Isles Beach Resort Association had a very good 15-minute presentation about this area <br />regarding hotels that have gone up, etc., and what has been happening in the area, and <br />something like that is really interesting and could be played, the developments that we were <br />thinking of doing at the very beginning and where we are, and that is in the files. <br /> <br />Cassey Gabor suggested historic moments like old motels, some educational things, and <br />Mayor Edelcup said we may be able to film History Hall with a commentary from our City <br />Historian Richard Schulman. Mayor Edelcup suggested if any of the residents do have ideas <br />of what they would like to see on Channel 77 to please contact us in writing so we will have <br />a file of what it is that residents may like to see, and if we can work it into a systematic <br />programming, it will only enhance what we are able to do. <br /> <br />12D. Discussion on the Status of Negotiations relating to FPL Franchise Fees. <br /> <br />Action: City Attorney Ottinot reported giving some background information noting that the <br />County has agreed to repay two years out of the four years. Mayor Edelcup reported that this <br />has been an ongoing dispute by the five cities of A ventura, Key Biscayne, Pinecrest, Miami <br />Lakes and Sunny Isles Beach. He said three cities have met this week to discuss the <br />County's recent proposal to us which was to give us half of the money that was owed to us, <br />for the first two years of the four years they withheld monies to us in the neighborhood of <br />$400,000 and noting for the total four years they withheld monies that we believe belong to <br />the City of over $800,000. Mayor Edelcup said that they have suggested that perhaps to <br />admit their error in withholding this and it was withheld unilaterally it was not by a consent <br />on our part, and they suggested that they would pay back the $400,000 over a longer period <br />of time, some four years. He said in addition, the County would like to rewrite into the <br />future, the amount of the monies that they would refund to us for franchise fees and they are <br />suggesting a number for Sunny Isles Beach that would basically be maybe a third of what we <br />feel is the shortfall that we are experiencing every year. He said in our discussion with the <br />other two cities, that the amount they are offering Sunny Isles Beach the one-third of the <br />differential was much smaller than what they were offering some of the other cities so their <br />formula still is not necessarily being fair to the City of Sunny Isles Beach nor are they being <br />fair in trying to only give us back half of what we are entitled to. <br /> <br />Mayor Edelcup stated that his position is, and he hopes the other cities will agree, that we <br />should not settle for anything less than the full amount ofthe monies that we were entitled to <br />under our agreements with the County. He said as it relates out into the future, ifthe County <br />wants to sit down and negotiate future and not past we would be willing to sit down with the <br />cities affected by this and discuss a new formula that if the County can convince us it is a <br />more fair treatment for all parties involved then certainly we wouldn't take a hard stand <br />position of what the formula was before. <br /> <br />Mayor Edelcup said what we are asking the County to do is to first agree to pay the four <br />years that they withheld from us even if they can't pay it in one lump sum that we would take <br />17 <br />
