<br />Summary Minutes: Regular City Commission Meeting <br /> <br />May 18, 2006 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />owners duty to remove it, and Mr. Solera said it is the owner's duty to remove it but within <br />the Ordinance we have a stipulation that we are conscious to the fact that a property owner <br />may be targeted and fines would not be imposed. City Attorney Ottinot said that the <br />Ordinance provides some discretionary authority to the City Manager and his staff. <br /> <br />Commissioner Iglesias moved and Commissioner Thaler seconded a motion to approve the <br />proposed ordinance on first reading. The motion was approved by a roll call vote of 5-0 <br />in favor. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending <br />Sections 233-3 and 233-5 of the Code of the City of Sunny Isles Beach to Increase the <br />Application Fee for Special Events Permits; Creating an Application Fee Schedule for <br />Special Events Permits; Repealing Section 233-5 in its Entirety; Providing for Severability; <br />Providing for Repealer; Providing for Inclusion in the Code; Providing for an Effective Date. <br />(First Reading 04/11/06) <br /> <br />Action: City Clerk Hines read the title and Code Enforcement and Licensing Director Robert <br />Solera reported, noting that since FY 2004/05 the Department has received 374 applications <br />for a Special Event Permit. <br /> <br />Public Speakers: none <br /> <br />Commissioner Goodman asked where would these special events be taking place, and Mr. <br />Solera said on private property outside, for instance at a hotel on the east side of Collins <br />Avenue or any residential zone. Commissioner Goodman asked if you own a house and you <br />have a party on your lawn, would you need a permit, and Mr. Solera said if the party on the <br />lawn includes music that creates a problem or affects surrounding property owners, yes, you <br />would have to have a permit. Mr. Solera noted that they have not received any requests from <br />residential zones, it has been more in terms with commercial, such as hotels on the east side. <br /> <br />City Attorney Ottinot noted that in the past the Commission has requested that fees be <br />reviewed on an annual basis and so he will add a provision that management staff should <br />review the fees on an annual basis. <br /> <br />5 <br />
