Summary Minutes: Regular City Commission Meeting January 19,2006

City of Sunny Isles Beach, Florida

monument sign a little bit bigger because there are 30-40 stores and on the monument signs
you are only allowing ten stores to be on them. He said since he is in the back he needs some
kind of visibility. Assistant City Manager Vera said he needs direction from the Commission
as it is not only him but there are others as well. Mayor Edelcup said we have already
designated in the Code the size of a monument sign, it is then up to the landlord of that
property to designate how he wants to split that monument into as many signs as is allowable
in the space that is provided by that monument and it is not up to the City at that point other
then to designate the overall size of the sign.

City Attorney Ottinot noted on page 34 of the agenda packet, [page 8 of the Ordinance] under
section 265.52 (A) (3), and Mayor Edelcup said it reads "All signs which display services or
products as opposed to the business name." and he suggested that we need to open that up to
include some services, as he went around the City with City Attorney Ottinot and Assistant
City Manager Vera, they noticed places like Walgreens, that say "Pharmacy Open for 24
Hours", that would have to be permitted because not all Walgreens stores have 24-hour
pharmacy service. He said we need the sign in its total space being the controlling item and
what goes within that space to allow some discussion with the property owners. He said we
don't want them advertising daily specials, it is a permanent sign. He said the amendment
that he was suggesting is to incorporate the fact that within that space they can designate but
they cannot exceed the size of that space.

Commissioner Thaler moved and Vice Mayor Brezin seconded a motion to approve the
proposed ordinance on first reading, as amended. The motion was approved by a roll
call vote of 5-0 in favor. Second reading, public hearing will be held on Thursday,
February 16,2006, at 7:30 p.m.
V ote: Commissioner Goodman ~
Commissioner Iglesias ~
Commissioner Thaler yes
Vice Mayor Brezin ~
Mayor Edelcup ~

7B. Public Hearing
An Ordinance of the City Commission ofthe City of Sunny Isles Beach, Florida, Amending
Article VII of the Land Development Regulations of the City of Sunny Isles Beach to Create
a Zoning Overlay District Entitled Cultural and Educational Zoning Overlay District
("CED"); Providing for Purpose and Intent; Providing for Permitted and Conditional Uses;
Prohibiting Certain Uses; Providing for Site Development Standards; Providing for Land
Dedication for Right-of-Way and Open Space; Establishing Boundaries for the District;
Providing that the City's Zoning Map Shall be Amended to Include the Cultural and
Educational Zoning Overlay District; Providing for Severability; Providing for Repealer;
Providing for Inclusion in the Code; Providing for an Effective Date.

Action: Mayor Edelcup noted that we are only proposing this Ordinance, that there is no site
plan review in front of them tonight. City Clerk Hines read the title, and Assistant City
Manager Vera reported noting that the purpose of this Ordinance is to create and encourage
locations for cultural, educational, government, residential, and business uses within the
northeast corridor of the City. He said it is also designed to facilitate pedestrian and vehicular
5
