Action: City Clerk Hines read the title and Assistant City Manager Douglas Haag reported. Public Speakers: none Commissioner Brezin moved and Vice Mayor Thaler seconded a motion to approve the resolution. Resolution No. 2007-1083 was adopted by a voice vote of 4-0-1 (Commissioner Goodman absent) in favor. 100. A Resolution of the City of Sunny Isles Beach, Florida, Approving an Agreement with Rein Triefeldt in Substantially the Same Form for the Design, Construction, Delivery and Installation of a Sculpture Entitled "Blue Admiral Butterfly, the Caterpillar's Dream" at the Gwen Margolis Park, an Amount Not to Exceed $55,000.00, Attached Hereto as Exhibit "A"; Authorizing the Mayor to Execute Said Agreement; Authorizing the City Manager to Do All Things Necessary to Effectuate the Terms of the Agreement; Providing for an Effective Date. Action: City Clerk Hines read the title and Mayor Edelcup reported, noting that this is art in public places. Public Speakers: none City Attorney Ottinot said that he can have the artist in town with pictures to present to the City Commission prior to installation. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Authorizing the City Attorney to Retain Services of the Law Firm of Shutts & Bowen, and Specifically, Sidney C. Calloway, Esq. as Outside Counsel, Specifically to Handle All Litigation Arising from the Lawsuit City of Sunny Isles Beach v.18100 Collins Avenue Shopping Center, Inc. at an Hourly Rate of$250.00; Authorizing the City Attorney to Do All Things Necessary to Effectuate the Terms of this Resolution; Providing for an Effective Date. Action: City Clerk Hines read the title and City Attorney Ottinot reported and noted that the trial is set for May. He also noted that Norman Malinsky withdrew from this case.
