<br />Summary Minutes: Regular City Commission Meeting February 21, 2008 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />actions, and Mr. Solera responded that was correct. Commissioner Goodman asked about <br />new planting restrictions, and Community Development Director Solera said new plantings <br />have less intense restrictions as it allows them to water their new plants at night from 2:00 <br />a.m. to 8:00 a.m. Monday through Wednesday, for the first 30 days, and then again for the <br />next 30 days. Commissioner Goodman said then that Code Enforcement would monitor that <br />to make sure it is enforced, and Community Development Director Solera said that is correct <br />with the help of the Police Department. He said when they are not there to respond to <br />complaints, the Police Department will respond and then produce a report to Code <br />Enforcement. He said he has also issued articles in the newspaper as well as on the website to <br />indicate that. Commissioner Brezin said she has been following this on Channel 77 and that <br />the City has done an excellent job in presenting this information. Commissioner Scholl said <br />that the warning process is important to give people time to adjust. <br /> <br />Commissioner Brezin moved and Commissioner Scholl seconded a motion to approve the <br />proposed ordinance on first reading. The motion was approved by a roll call vote of 4-0- <br />1 (Vice Mayor Thaler absent) in favor. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending <br />Section 265-11(N)(3) of the City Code to Permit a Volunteer Program for Extension of <br />Time for Unexpired Development Approvals; Providing for Severability; Providing for <br />Inclusion in the Code; Providing for Repealer; Providing for an Effective Date. <br /> <br />Action: City Clerk Hines read the title, and City Attorney Ottinot reported that development <br />approvals expire within 24 months of approval if the developer does not pull a Building <br />Permit, and at a recent workshop the City Commission instructed staff to create a voluntary <br />program to provide for extension of time for unexpired development approvals. He said the <br />purpose of this ordinance is to create the legal authority that would permit the establishment <br />of a voluntary program to apply for an extension of time for development approvals due solely <br />for economic reasons/market conditions relating to the housing market. <br /> <br />Public Speakers: Clifford Schulman, Esq.; Hector Dasso; Estrellita Siblia <br /> <br />Mayor Edelcup asked if we should hear item 10E in conjunction with this item, and City <br />Attorney Ottinot said yes. City Clerk Hines read the title of item 10E into the record, and City <br />Manager Szerlag reported that at our last workshop session there were indications by the <br />development community that perhaps the time extensions correlated with the amount of <br />money being requested for the voluntary program was a little steep, and so they have as an <br />alternate proposal to keep the money the same but to double the time frame. <br /> <br />City Manager Szerlag presented a power point on an "Alternative Policy for Voluntary Time <br />Extensions", for a two-year extension that would require voluntarily 15% of the balance <br />owed the City, or $500,000 whichever is greater, and there would also be an interest rate on <br />4 <br />
