<br />Summary Minutes: Regular City Commission Meeting October 20,2011 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />Public Speakers: None <br /> <br />Mayor Edelcup said another benefit is that our people can get to Surfside, get on their system <br />and then go down to South Beach, and so it is a win-win for both sides. Vice Mayor Thaler <br />said we will add it to the book that we send out, and Ms. Simpson said we are in the process <br />of redesigning the schedule and that would be included in the book. <br /> <br />Commissioner Aelion moved and Vice Mayor Thaler seconded a motion to approve the <br />resolution. CITIZENS' FORUM: REQUESTS, PETITIONS & OTHER COMMUNICATIONS <br /> <br />13A. Arlene Koenig said this matter is urgent and affects everybody, this is a issue of <br />secondhand smoke in residential environment. She lives in Winston Towers and she got <br />involved in this personally because she had an issue in her building with secondhand smoke <br />filtering into the building. This is a deeper issue in that nothing has been done to address this <br />health hazard. She called Tallahassee and found out that Florida Statute 386 covers <br />professional and business buildings but there is nothing on the books that covers residential <br />buildings. Smokers are not protected under the housing law and therefore we have an <br />opening here particularly under the nuisance portion of Statute 3 86. We have an opportunity <br />in this community to be proactive and to affect the bottom line because 493,000 people die <br />every year from secondhand smoke. She understands that the City Attorney probably has <br />issues about the viability of issuing summons or warnings to people who smoke. She has a <br />lot of information from different areas in the United States about this issue and legal issues <br />and she will give it to someone here. She said ifthere is not a City committee to address this, <br />she is willing to give her time to start the ball rolling. Outreach starts here, education starts <br />here, it means you have to go to every one of these buildings and deal with this issue. <br />Education is not worthy unless you teach people how to apply it, and that starts here, and this <br />Commission has an obligation to protect the residents in this community. <br /> <br />Mayor Edelcup asked the City Manager and the City Attorney to review the situation and to <br />give us a report at the next meeting as to what we can do or not do. Ms. Koenig gave the <br />packet of information to the City Attorney and she wanted to leave handouts for residents, <br />however, Mayor Ede1cup asked her to wait until such time as we get a report from the City <br />Manager and City Attorney. Commissioner Aelion asked her if she found any other states <br />that has laws for this in high-rises, and she said yes, in New York City and other states which <br />is in the packet she gave the City Attorney. Also, she is working with the Miami-Dade <br />County Health Department and they have a special task force, the next meeting is November <br />28,20 II which she is becoming a member of.
