<br />LPA RESOLUTION NO. 2011- <.08 <br /> <br />A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, RECOMMENDING <br />TO THE CITY COMMISSION OF SUNNY ISLES BEACH, THE <br />ORDINANCE AMENDING CHAPTER 265 "ZONING" <br />INCLUDING SECTION 265-37 "TOWN CENTER ZONING <br />DISTRICT", SECTION 265-35 "MIXED USE-RESORT DISTRICT <br />(MU-R)", AND SECTION 265-23 "TRANSFERS OF <br />DEVELOPMENT RIGHTS", ATTACHED AS EXHIBIT "A"; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commissioners, serving as the Local Planning Agency ("LP A"), <br />conducted a public hearing relating to the Land Development Regulations on December 10, 2002 <br />and adopted the Land Development Regulations by Ordinance No. 2002-165; and <br /> <br />WHEREAS, the City Commission, as the LP A, has reviewed the amendment to Chapter <br />265 "Zoning" including Section 265-37 "Town Center Zoning District" to provide for <br />transferring building heights within the Sunny Isles Beach Boulevard South Edge Street Type <br />within the Town Center District; and including amending Section 265-35 "Mixed Use-Resort <br />District (MU-R)" to modify Floor Area Ratio Bonuses, establish Federal Aviation <br />Administration Restrictions as height limitations therein, adjust interior side setbacks for parcels <br />200 feet or more in width, and to permit connecting bridges between certain adjacent properties; <br />and including amending Section 265-23 "Transfers of Development Rights" to establish Federal <br />Aviation Administration Restrictions as the height limitation for receiving sites; and <br /> <br />WHEREAS, the LP A has determined that it is in the best interest of the City and its <br />residents to recommend approval of the Ordinance amending Chapter 265 of the Land <br />Development Regulations. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: <br /> <br />Section I. Recommendation: That the Local Planning Agency hereby recommends to the City <br />Commission of the City of Sunny Isles Beach, the Ordinance amending Chapter 265, Section 265- <br />37, Section 265-35, and Section 265-23 of Land Development Regulations Ordinance No. 2002- <br />165, attached as Exhibit "A," for consideration by the City Commission pursuant to Chapter 163, <br />Florida Statutes. <br /> <br />Section 2. Effective Date: This Resolution shall take effect immediately upon adoption. <br /> <br />PASSED AND ADOPTED this I ih day of November 2011. <br />
