If <br />development is permitted in phases the bonus contribution shall be prorated for each <br />phase. <br /> <br />10. That in the event of multiple ownership, a homeowner's association be established in <br />accordance with applicable regulations to assure that all common areas and facilities for <br />the residents, as well as all easements dedicated to the City, shall be maintained in <br />continuous and satisfactory manner and without expense to the general taxpayers of the <br />City of Sunny Isles Beach. <br /> <br />11. That the Applicant comply with all conditions and permit requirements, including but not <br />limited to Miami-Dade County, including environmental conditions and permitting, the <br />Fire and Water and Sewer Departments, Florida Department of Environmental Protection <br />(DEP) and Florida Department of Transportation (FOOT). <br /> <br />12. No building permits shall be issued (except for demolition and sales trailers) unless the <br />Applicant has submitted all documents referred to under this approval and shall have paid <br />all impact fees, bonuses, and Transfer of Development Rights (if applicable), <br />professional fees (as per Ordinance 2001-132 and such other applicable Land <br />Development Regulations) due to the City. <br /> <br />13. Pursuant to Resolution 2011-1810, the Applicant has agreed to provide a warranty deed <br />to the City donating the following described land located adjacent to the property <br />commonly known as the Ocean Food Market Property that the City intends to use to <br />construct an intracoastal park: <br /> <br />All that part of Lots 87 and 88 of TATUM'S OCEAN BEACH PARK SUBDIVISION, recorded in Plat <br />Book 5, at Page 35, of the Public Records of Miami-Dade County, Florida lying Westerly of the Westerly <br />line of the 100.00 foot Right-of-Way of State Road No. 140, now known as State Road A-i-A, as the center <br />line of same is recorded in Plat Book 45, at page 39, of the Public Records, of Miami-Dade County, <br />Florida, said lots surveyed to face of a concrete bulkhead cap lying Westerly of the said Westerly line of <br />State Road A-I-A. <br /> <br />B. CONDITIONS TO BE COMPLETED BEFORE ANY CERTIFICATE OF <br />OCCUPANCY IS ISSUED. <br /> <br />1. That the Applicant demonstrates that they are in compliance with all terms and <br />conditions under this approval. <br /> <br />2.
