<br />RESOLUTION NO. ll-Z -Jh4 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING THE <br />ZONING APPLICATION SUBMITTED BY LPLA PARTNERS, LP. <br />(THE "APPLICANT"), (Z2011-06), PURSUANT TO SECTION 265- <br />18 OF THE LAND DEVELOPMENT REGULATIONS OF THE <br />CITY OF SUNNY ISLES BEACH ("LDRS"), TO PERMIT THE <br />DEVELOPMENT OF "THE MANSIONS AT ACQUALINA", A 46- <br />STORY CONDOMINIUM BUILDING WITH 79 UNITS, ON THE <br />PROPERTY LOCATED AT 17749 COLLINS AVENUE; <br />PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING <br />FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I. RECITALS <br /> <br />WHEREAS, LPLA Partners, LP (the "Applicant") submitted a zoning application to the <br />City of Sunny Isles Beach, Florida (the "Application") (Z20 11-06), requesting the following: <br /> <br />1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a site plan approval for a 46 story building with <br />79 condominium units. <br /> <br />2. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting to transfer 25,000 square feet of development <br />rights and 9 units. An adjustment to be made for a decrease of 25,000 square feet and 9 <br />units from the City's Transfer of Development Rights Bank. <br /> <br />3. Pursuant to Section 265-35(D)(8) of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a waiver of the required beach access easement. <br /> <br />LEGAL: Portion of Gov1. Lot 6 <br />Tatum's Ocean Park Subdivision (PB 10-64) <br />N 100 ft. of Tract 4 East of State Route A 1 A and S 100 f1. of Tract A (PB 35-51) <br /> <br />ADDRESS: 17749 Collins Avenue <br /> <br />WHEREAS, on December 22, 2011, the City Commission conducted a public hearing <br />on the Application; and <br /> <br />WHEREAS, the public hearing of the City Commission was advertised and held as <br />required by law, all interested parties concerned in the matter were heard, and due and proper <br />consideration was given to the matter and to the positive recommendation contained in the City's <br />Community Development Department Review Report; and <br /> <br />11-2- 17749 Collins Avenue <br />
