<br /> <br />These vendors shall then be deemed to be pre-qualified to participate in subsequent spot market <br />purchases as required by the City on either an as-needed or on a periodic basis. When such spot <br />market purchases are initiated, the pre-qualified vendors shall be invited to offer a fixed price for <br />a specific individual purchase, or a specific purchasing period. The vendor then offering the <br />lowest fixed price shall be awarded for the specific period or specific purchase. The award to one <br />vendor for a specific period or individual action does not preclude the remaining pre-qualified <br />vendors from submitting spot market offers for other specific purchases. <br /> <br />It shall be the sole prerogative of the City as to the number of vendors who will be initially <br />included under this contract. During the term of this contract, the City reserves the right to add <br />or delete vendors as it deems necessary in its best interests. If the City elects to add vendors, <br />they must meet the same minimum qualifications established for the original competition. <br /> <br />2.6 PRICE <br /> <br />If the Proposer is awarded a contract under this solicitation, the discounts proposed by the <br />proposer shall remain fixed and firm during the Initial term of contract and each subsequent <br />renewal. <br /> <br />2.7 PERFORMANCE BOND <br /> <br />Intentionally Omitted <br /> <br />2.8 DELIVERY <br /> <br />All bidders shall quote prices based on F.O.B. Destination and shall hold title to the goods until <br />such time as they are delivered to, and accepted by, an authorized City representative <br /> <br />2.9 INDEMNIFICATION <br /> <br />Comprehensive General Liability with minimum limits of One Million Dollars ($1,000,000.00) per <br />occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. <br />Coverage must be afforded on a form no more restrictive than the latest edition of the <br />Comprehensive General Liability policy, without restrictive endorsements, as filed by the <br />Insurance Services Office, and must include: <br /> <br />o Premises and Operation <br />o Independent Contractors <br />o Products and/or Completed Operations Hazard <br />o Broad Form Property Damage <br />o Broad Form Contractual Coverage applicable to this specific Contract, including any hold <br />harmless and/or indemnification agreement. <br />o Personal Injury Coverage with Employee and Contractual Exclusions removed, with <br />minimum limits of coverage equal to those required for Bodily Injury Liability and <br />Property Damage Liability. <br /> <br />City of Sunny Isles Beach I Request for Proposal No. 12-01-05 <br /> <br />
