<br />Summary Minutes: Regular City Commission Meeting February 16,2012 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />13B. Discussion by Maria Elvir regarding Sahara Beach Club Condo Unit Owners. <br />Action: Maria Elvir said she has been an owner at the Sahara Beach Club Condo for the past <br />26 years, and is here representing all the owners at the Sahara Beach Club. She said they <br />have a run away Association and she is here asking the Commission to come forward and <br />give her a hand with this situation. The biggest problem is that they are not abiding by the <br />State law. She said the Police Department has not responded to any of her requests. She said <br />she has put in canceled checks, receipts, and there are tens of thousands of dollars of <br />improperly used funds that are unaccountable for. She is asking the Commission for help <br />with the Police Department. <br /> <br />City Attorney Ottinot asked Ms. Elvir to come and see him to get all the facts to be able to <br />determine if it is a Police issue or a civil issue. Police Chief Fred Maas said the Police <br />Department has reached out in the last several days since they received a letter from her, and <br />she has met with the Investigator Lieutenant. He said there is a very clear line between issues <br />that are civil in nature which often times occur in these condominiums and it is not the Police <br />Department's responsibility to investigate it, it is their responsibility to move forward when <br />items of a criminal nature are brought to them but they must show that they are items of a <br />criminal nature. Captain Snyder has placed a couple of calls to make an appointment with <br />Ms. Elvir to come in and go over this again. He has been monitoring this since he received <br />her letter, and met with his staff and also to determine what has been turned in and there has <br />been incomplete steps that are required before going to the State Attorney's Office.
