<br />ARTICLE 11 <br />SEVEHABILITY CLAUSE AND ZIPPER CLAUSE <br /> <br />Section 1. Should any provision of this collective bargaining agreement, or any <br /> <br /> <br />part thereof, be rendered or declared invalid by reason of any existing or subsequently <br /> <br /> <br />enacted state or federal law, or by any decree of a court of competent jurisdiction, all <br /> <br /> <br />other articles and sections of this Agreement shall remain in full force and effect for the <br /> <br /> <br />duration of this Agreement. The parties agree to immediately meet and confer concerning <br /> <br /> <br />any invalidated provision(s). <br /> <br />Section 2. The parties acknowledge that during the negotiations which resulted in <br />this Agreement, each had the unlimited right and opp0J1unity to make demands and proposals <br />with respect to any subject or matter not removed by law from the area of collective <br />bargaining and that the understanding and agreement arrived at by the parties atler the <br />exercise of that right and opportunity are set forth in this Agreement. Therefore, the City and <br />the Union, for the life of this Agreement, each voluntarily and unqualifiedly waives the right <br />and each agrees that the other shall not be obligated to bargain collectively with respect to <br />any subject or matter referred to or covered by this Agreement and with respect to any subject <br />or matter not specifically referred to or covered in this Agreement, even though such subject <br />or matter may not have been within the knowledge and-contemplation of either or both of the <br />parties at the time they negotiated or signed this Agreement. Except as provided by Article 12 <br />hereof, this Agreement contains the entire Agreement of the parties on all matters relative to <br />wages, hours, terms and conditions of employment as well as all other matters, which were <br />or could have been negotiated prior to the execution of this Agreement. This Section <br />does not prohibit the parties from entering into negotiations concerning the terms of a <br />successor Agreement. <br /> <br />- 14. <br />
