<br />Step 4: If the grievance is not resolved at Step 3, or if no written disposition is <br />madc within the Step 3 time limits, he/she shalJ have the right to appeal the Step 3 decision to <br />the Chief of Police or his or her designee within seven (7) calendar days of the date of the <br />issuance of the Step 3 decision. Such appeal must be accompanied by the filing of a copy of <br />the original written grievance, together with a request form signed by the employee <br />requesting that the Step 3 decision be reversed or modified. The Chief of Police or his / her <br />designee shalJ conduct a meeting with the grievant and his / her pBA representative, if <br />needed. The Chief of Police or his/her designee shall, within ten (10) calendar days (or such <br />longer period of time as is mutualJy agreed upon in writing), render his/her decision in <br />writing to the aggrieved employee. <br />Step 5: If the grievance is not resolved at Step 4, or if no written disposition is <br />made within the Step 4 time limits, he/she shall have the right to appeal the Step 4 decision to <br />the City Manager or his or her designee within seven (7) calendar days of the date of the <br />issuance of the Step 4 decision. The City Manager or his / her <br />designee shall conduct a meeting with the grievant and his / her PBA representative, it' <br />needed. The City Manager or his/her designee shalJ, within ten (10) calendar days (or such <br />longer period of time as is mutually agreed upon in writing), render his/her decision in <br />writing to the aggrieved employee. <br /> <br />Section 6. A grievance not advanced to the higher step within the time limits <br />provided shall be deemed permanently withdrawn as having been settled on the basis of the <br />decision most recently given. Failure on the part of the City to answer within the time limits <br />set forth in any step will entitle the employee to proceed to the next step. The time periods <br />contained herein may be mutualJy waived or extended due to unforeseen circumstances. <br /> <br />Section 7. Where a grievance is general in nature in that it applies to' a number of <br /> <br /> <br />employees having the same issue to be decided, it shall be presented directly to the Chief of <br /> <br /> <br />Police or his/her designee at Step 4 of the grievance procedure, within the time limit provided <br /> <br /> <br />for the submission of the grievance in Step I, and signed by the aggrieved employees or the <br /> <br /> <br />pBA representative on their behalf. <br /> <br />- 18- <br />
