That Applicant shall obtain concurrency review approval from Miami-Dade County School <br />Board. <br /> <br />13. The Applicant submits voluntarily and freely the $25,000 donation to the Sunny Isles <br />Beach K-8 Trust Fund for scholarship purposes as part of the mitigation impact to waive <br />the beach access easement requirement. The total mitigation amount shall be paid within <br />three (3) working days of approval of the site plan application. <br /> <br />14. The Applicant agrees to proffer certain public improvements including; (i) the <br />redevelopment of the north portion of Samson Oceanfront Park with new playground <br />equipment, landscaping, and paved walkway; (ii) construction of a decorative band shell <br />on the southern portion of Samson Oceanfront Park; and (iii) installation of decorative <br />paver sidewalk in front of the subject property as well as in front of the Monaco Motel <br />(Travelodge), as part of the as part of the mitigation impact to waive the beach access <br />easement requirement. The decorative paver shall be identical to the decorative pavers <br />installed by the City in accordance with the Streetscape Master Plan. The public <br />improvements set forth in this paragraph shall be approved by the City Manager or <br />designee before installation. <br /> <br />15. That the Applicant must present evidence of performance to the Community <br />Development Department of the obligation required to qualify for the Floor Area Ratio <br />bonus. In the event that the Applicant has done so and prior to issuance of the <br />Certificate of Occupancy the Applicant shall acquire the following floor area ratio <br />bonuses: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br /> <br />Beach Access Trust Fund Bonus 0.30 FAR <br />Public Beach Rec. That the Applicant shall enter into a License Agreement with the City for the use of <br />limited area of Samson Ocean Park for staging purposes. <br /> <br />17.
