WHEREAS, the City Commission reviewed the request for modification, the written and <br />oral recommendations of the Community Development Department and all outside consultants who <br />render reports with respect to the Application, including the recommended conditions, and finds <br />substantial competent evidence to support a showing by the Applicant that the requests for the <br />transfer of development rights and for site plan approval are in compliance with the Land <br />Development Regulations and the Comprehensive Master Plan of the City and maintain the basic <br />intent and purpose of the zoning, subdivision or other land use regulations, which is to protect the <br />general welfare of the public, particularly as it affects the stability and appearance of the <br />community; and, further finds that said requests should be granted, subject to the conditions <br />described herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />II. INCORPORATION OF RECITALS <br />All recitals above are incorporated into the body of this Resolution as if same were fully set forth <br />herein. <br />III. FINDINGS AND CONCLUSIONS: <br />Based upon an analysis of the application and the standards for approval for a site plan modification <br />and variances under the Land Development Regulations, the City Commission makes the following <br />findings and conclusions: <br />A. The request to modify the approved site plan and the requests for variance are consistent <br />with the Land Development Regulations and the Comprehensive Master Plan of the City of <br />Sunny Isles Beach. <br />B. The Applicant's variance requests are supported by competent and substantial evidence and <br />approval is warranted under Section 265 -15 of the City Code. <br />IV. APPROVALS <br />A. The Applicant's request for modification of the approved site plan submitted for the Project <br />known as "Mansions at Acqualina" is hereby granted and said site plan is hereby modified <br />subject to all conditions set forth in Section V below. <br />B. The Applicant's request to modify the tandem parking counts from 20% to 100% where the <br />100% is permitted by City Code is hereby approved. <br />C. The Applicant's variance request to permit a portion of the tower side setbacks to be 46 feet <br />and six inches where a minimum of 50 feet is required is hereby approved. <br />12 -Z - -- 17749 Collins Avenue 2 <br />
