J <br />Ms. Claudia Hasbun, Zoning Administrator <br />February 17, 2012 <br />Page 4 <br />On December 22, 2011, the Commission approved Resolution No. ll -Z -124 and <br />approved the development for this project. Since then, further marketing research has been done <br />and it appears potential unit owners would prefer to enclose certain balconies on the project so <br />that an extended breakfast nook can be created utilizing a bay window where a balcony was <br />previously designed. <br />Moreover, some of the potential purchasers of units have indicated a preference for the <br />creation of a unit that contains a fifth bedroom, rather than the four bedroom maximum <br />previously approved. Lastly, due to the ordinances in existence at the time of the above -noted <br />approval, only 9 mechanical lifts were proposed in order to not require a variance from the then <br />existing code restrictions. . . <br />Our architectural team has determined that such modifications can be accomplished <br />without any increase in the number of units or the intensity of the project, previously approved. <br />Moreover, since the original approval, the City Commission has approved, on first reading, an <br />ordinance that would allow 100% tandem (mechanical) parking as long as 24/7 valet parking <br />services were provided and guaranteed as part of a binding covenant running with the land. <br />Approval of the requested zoning relief is appropriate pursuant to Section 265 -15 of the <br />LDRs based on the following since it will not impact the previously approved design of the <br />building and will not increase any impacts of the development. <br />Thank you for your consideration of this application.
