- 1y�MNT IJ<J <br />O <br />CITY OF SUNNY ISLES BEACH <br />NOTICE OF ZONING NEARING <br />NOTICE IS HEREBY GIVEN that a public hearing will be held by the City . <br />Commission of the City of Sunny Isles Beach, Florida, in the David P: Samson <br />Commission Chambers, Sunny Isles Beach Government Center, 18070 Collins <br />Avenue, Sunny Isles Beach, Florida on Thursday, March 15, at 6:30 p.m., to <br />consider the following Zoning application: <br />Application: - The Mansions at Acqualina - <br />Location: 17749 Collins Avenue <br />Public Hearing li: Z2012 -03 <br />Summary: <br />The Applicant is requesting a modification of the approved site plan. To include <br />an increase of tandem parking and a variance to encroach into the tower side <br />setbacks by 3 feet 6 inches with bay windows. - <br />Requests: - -- - - - <br />1. Pursuant to Section 265 -18(I) of the City of the City of Sunny Isles Beach <br />Land Development Regulations, the Applicant is requesting the following <br />modifications to an approved site plan pursuant to Resolution No. <br />11 -Z -124, <br />a). Pursuant to Section 265 -46 (A)(4) of the City of the City of Sunny Isles <br />Reach Land Development Regulations, the Applicant is modifying the <br />tandem parking counts from 20% to 100% :where the 100% is allowed <br />by Code.. _ <br />b) Pursuant to Section 265-15 of the City of Sunny Isles Beach Land <br />Development. Regulations, the Applicant is requesting variance of <br />Section 265- 35(D)(4)(c)[1)(a) to permit a portion of the tower side <br />setbacks to be 46 feet and six inches where a minimum of 50 feet is <br />required. <br />Plans are on file and may be examined in the City Clerk Offices for Mansions <br />at Acqualma ( Seven sheets), date received February 29, 2012. <br />Legal: Portion of Govt. Lot 6 Tatum's Ocean Park Subdivision (PB 10 -64)N 100 <br />ft. of Tract 4 East of State Route Al A and S 100 ft., of Tract A (PB 35 -51) <br />Size of Property: 1.042 acres (45,394 sq ft) <br />Zone: Mixed Use- Reson(MU -R) - <br />All persons are invited to appear at this meeting or be represented by an agent, or <br />to express their views in writing addressed to the City Clerk, City of Sunny Isles <br />Beach, 18070 Collins Avenue, Sunny Isles Beach, Florida, 33160. The courts <br />have ruled that it is improper to contact a City Commission member individually, <br />either orally or in writing about any zoning: applications. Maps and other data <br />pertaining, to these applications are available for public inspection during normal <br />business hours in City Hall. Any zoning hearing may be continued at this meeting <br />and under such circumstances, additional legal notice would not be provided. <br />Any persons wishing to speak at a public hearing should register with the City <br />Clerk prior to that item being heard. Inquiries regarding the item may be directed <br />S to the City Clerk at (305) 792 -1703. Please refer to the hearing number when <br />making an inquiry, If a person decides to appeal any decision made by the City <br />Commission with respect to any matter considered at such meeting or hearing, <br />they will need a record of the proceedings and, for such purpose, may need to <br />ensure that a verbatim record of the proceedings is made; which record includes <br />the testimony; and evidence upon which the appeal is to be based. This notice <br />does not constitute consent by the City for introduction or admission of otherwise <br />inadmissible or irrelevant evidence, nor does it authorize challenges or appeals <br />not otherwise allowed by law.
