In addition, on 1996 Miami -Dade County approved a hearing for a Synagogue to be <br />established within the shopping plaza, that use currently exists. Public hearing application No. Z2011 -03 <br />was denied by City Commission on July 21, 2011 under Resolution 11 -Z -122. <br />IV. Applicant's Request <br />1. Pursuant to Section 265 -13 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a conditional use approval for a Daycare Center <br />in the RMF -2 Zoning District. <br />2. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance of Section 265 -44 (D)(2) to permit a <br />— -- Child Care Center with -a maximum -of -25 children where 6 children are permitted. <br />Plans are on file and may be examined in the City Clerk Offices for Sunny Isles Daycare Corp <br />(Pg. 1), dated Feb. 8, 2012. <br />Legal: 2 & 11 52 42 1.254 AC M/L TATUMBS SUB GOVT LOT 6 PB 10 -64 BEG 100.48FTN & 1342.33FTW <br />OF X S/L TR 3 & W R/W /L SR AIA TH W 215.2FT N235FT NELY AD 39.27FT E 163.33FT S260FT TO POB <br />SUITE # 102 FOLIO NUMBER 31 -2211- 004 -0222. <br />V. Zoning General Standards of Review For Variance <br />In granting a variance, the City Commission must consider the following factors pursuant to <br />Section 265 -15 of the City Code. <br />(1) Special conditions and circumstances exist which are peculiar to the land, structure, or <br />building involved and which are not applicable to other lands, structures or buildings in the <br />same zoning district; <br />A special condition on the property relates to the existing Declaration of Covenant, which <br />allows business uses in the residential zoning district in which the building is located on. <br />(2) The special conditions and circumstances do not result from the actions of the petitioner; <br />The Applicant did not have control over the special condition placed on the site, when the <br />Declaration of Covenant was establish in 1979. <br />(3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights <br />commonly enjoyed by other properties in the same zoning district under the terms of this <br />chapter and works unnecessary and undue hardship on the applicant; <br />Literal interpretation of the provision of the LDRs deprives the Applicant rights. <br />SUNNY ISLES DAYCARE Z2012 -04 CH 2 <br />
