V. Zoning General Standards of Review For Variance In granting a variance, the City Commission must consider the following factors pursuant to Section 265 -15 of the City Code. (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district; A special condition on the property relates to the existing Declaration of Covenant, which allows business uses in the residential zoning district in which the building is located on. (3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant; Literal interpretation of the provision of the LDRs deprives the Applicant rights.
