Regulations and such variance will not be injurious to the area that is involved or otherwise detrimental to the public welfare. WHEREAS, the City Commission reviewed the Application, the written and oral recommendations of the Community Development Department and all outside consultants who render reports with respect to the Application, including the recommended conditions, and finds substantial competent evidence to support a showing by the Applicant that the requests for the transfer of development rights and for site plan approval are in compliance with the Land Development Regulations and the Comprehensive Master Plan of the City and maintain the basic intent and purpose of the zoning, subdivision or other land use regulations, which is to protect the general welfare of the public, particularly as it affects the stability and appearance of the community; and, further finds that said requests should be granted, subject to the conditions described herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: II. INCORPORATION OF RECITALS All recitals above are incorporated into the body of this Resolution as if same were fully set forth herein. III. FINDINGS AND CONCLUSIONS: Based upon an analysis of the application and the standards for approval for a site plan application and variances under the Land Development Regulations, the City Commission makes the following findings and conclusions: A. The site plan application for conditional use approval and the requests for variance are consistent with the Land Development Regulations and the Comprehensive Master Plan of the city of Sunny Isles Beach. B. The Applicant's variance request is supported by competent and substantial evidence and approval is warranted under Section 265 -15 of the City Code. IV. APPROVALS A. The Applicant's request for approval of a conditional use for a Daycare Center in the RMF - 2 Zoning District is hereby granted and said site plan is hereby approved subject to all conditions set forth in Section V below. B. The Applicant's request for a variance to increase the number of children for a child -care center from six (6) children to twenty five (25) children is hereby granted and said site plan is hereby approved subject to all conditions set forth in Section V below. 12 -Z - -- Sunny Isles Daycare Corp 2
