Insertion of Corrections or Modifications. <br /> <br />Typewritten or handwritten provisions inserted on this Agreement or on the exhibits hereto (and <br /> <br />initialed by both parties) shall control all printed provisions in conflict therewith. <br /> <br />28. Time. <br /> <br />Time is of the essence in this Agreement. <br /> <br />29. Counterparts. <br /> <br />This Agreement may be executed simultaneously or in counterparts, each of which together shall <br /> <br />constitute one and the same Agreement. <br /> <br />30. Assignability. <br /> <br />Buyers may not assign their rights hereunder without Seller's consent unless such assignment is <br /> <br />to a related party or entity to be formed by Buyers for the ownership, construction and/or development <br /> <br />of the Project. Upon any such assignment, any such assignee shall agree to be bound by the terms and <br /> <br />conditions set forth in this Agreement. <br /> <br />31. Agreement not to be Recorded. <br /> <br />This Agreement shall not be recorded in any public records by either party hereto. <br /> <br />32. Effective Date.
