Created by CH 032912 <br />Revised by SR 043012 <br />Revised by HO 050312 <br />(1) Upon the submittal of an application for building permit, the plans submitted shall meet with the <br />approval of the Planning and Zoning Administrator and be consistent with the specific site plan <br />approved by the City Commission. Plans shall include all the required elements of the site plan <br />pursuant to the City's Land Development Regulations. Should revisions in the plans result in a <br />change that would not be considered "minor" in accordance with Section 265 -18 of the City <br />Code; the Applicant shall be required to obtain another approval of the City Commission. <br />(2) That the project shall be developed substantially in accordance with the plans submitted for public <br />hearings on November 17, 2011 and May 10, 2012. All conditions set forth in City Resolution 11- <br />Z -123 shall remain in effect. <br />(3) That the Applicant shall acquire the following additional floor area ratio bonuses: <br />a) Public Beach Rec. Enhancement 0.10 FAR $ 318,240 <br />C) Educational and cultural 0.20 FAR $ 636,480 <br />The additional contribution for the Floor Area Ratio bonuses for the development is $954,720 for <br />a total bonus increase in floor area ratio of 1.8 for a maximum floor area ratio of 4.3. The <br />contribution of previously FAR bonus approved was $3,818,880. The total FAR bonus <br />contribution for the project is $4,773,600. <br />(4) That the Applicant pays a ten percent (10 %) non- refundable deposit to the City from the bonus <br />payment of $954,720 within three (3) business days of approval of this site plan modification. The <br />deposit amount is $95,472 with a balance of $859,248. <br />(5) That the Applicant shall enter into a promissory note agreement with the City to pay the <br />remaining balance of $859,248 for bonus payment approved pursuant to site plan modification. <br />Final payment of the balance shall be subject to a 4% yearly interest amount. Principal and <br />interest payment shall be due at the time of issuance of TCO for the Project or three (3) years <br />from date of issuance of building permit, whichever comes first. <br />(6) That the Applicant shall pay for bonus units obtained in the original zoning approval at the time of <br />issuance of the building permit in accordance with the City Code and the original site plan <br />approval. <br />(7) That the Applicant shall provide the necessary documents to prove ownership of 15,000 square feet <br />of transfer of development rights ( "TDRs ") prior to approval of the site plan. <br />PORSCHE DESIGN TOWER — MODIFICATION Z2012 -06 CH <br />
