kv <br />Upon the submittal of an application for building permit, the plans submitted shall meet with the <br />approval of the Planning and Zoning Administrator and shall be consistent with the specific site <br />plan approved by the City Commission. Plans shall include all the required elements of the site <br />plan pursuant to the City's Land Development Regulations. Should revisions in the plans result <br />in a change that would not be considered "minor" in accordance with Section 265 -18 of the City <br />Code, the Applicant shall be required to obtain another approval of the City Commission. <br />2. That the project shall be developed substantially in accordance with the plans submitted for <br />public hearings on November 17, 2011 and May 10, 2012. All conditions set forth in City <br />Resolution 11 -Z -123, adopted on November 17, 2011, shall remain in effect. <br />3. That the Applicant shall acquire the following additional floor area ration bonuses: <br />a) Public Beach Rec. Enhancement 0.10 FAR $ 318,240 <br />b) Educational and cultural 0.20 FAR $ 636,480 <br />The additional cash contribution for the Floor Area Ratio bonuses for the development is <br />$954,720 for a total bonus increase in floor area ratio of 1.8 for a maximum floor area ratio <br />of 4.3. The cash contribution of previously FAR bonus approval was $3,818,880. The total <br />FAR cash bonus contribution for the project is $4,773,600. <br />4. That the Applicant shall pay a ten percent (10 %) non - refundable deposit to the City from the <br />bonus payment of $954,720 within three (3) business days of approval of this site plan <br />modification. The deposit amount is $95,472 with a balance of $859,248. <br />5. That the Applicant shall enter into a promissory note agreement with the City to pay the <br />remaining balance of $859,248 for bonus payment approved pursuant to the site plan <br />modification. Final payment of the balance shall be subject to a 4% yearly interest amount. <br />Principal and interest payment shall be due at the time of issuance of TCO for the Project or <br />three (3) years from date of issuance of building permit, whichever comes first. <br />6. That the Applicant shall pay for bonus units obtained in the original zoning approval at the time <br />of issuance of the building permit in accordance with the City Code and the original site plan <br />approval. <br />7. That the Applicant shall provide payment of $975,000 to the City if Applicant includes in its <br />modified site plan 15,000 square feet of transfer of development rights ( "TDRs ") that were <br />conditionally granted to the Applicant. Payment for the TDRs shall be made no later than six <br />(6) months from issuance of building permit or evidence of actual use. <br />NO BUILDING PERMIT SHALL BE ISSUED UNLESS THE APPLICANT HAS SUBMITTED <br />ALL DOCUMENTS REFERRED TO UNDER THIS RESOLUTION AND SHALL HAVE PAID <br />ALL IMPACT FEES, BONUSES, AND TRANSFER OF DEVELOPMENT RIGHTS TO THE <br />CITY (IF APPLICABLE) OR OTHERWISE PRODUCED EVIDENCE THAT THE PERMITTED <br />PRIVATE DEVELPOMENT RIGHTS AS SET FORTH IN SECTION IV HEREIN ABOVE <br />12 -Z - -- 18555 Collins Avenue 3 <br />
