Williams, Jr. et al. v Landmark Companies, Inc. et al. <br />Case No: 04 -00568 CA 23 <br />D /A: June 16, 2002 <br />Sun -Tech Engineering (STE) was the civil engineering consultant for Landmark Companies, Inc. <br />Landmark Companies, Inc. was the developer of a low- income apartment complex in Dade County. <br />The case involved the drowning of a 4 -year old boy on June 16, 2002 which took place in a canal <br />adjacent to the project. The canal pre -dates the development. STE was under contract with the <br />developer responsible for on -site infrastructure i.e., water, sewer, paving, grading and drainage. The <br />child and his parents were tenants at the development. <br />The child's parents sued the developer, Architect, STE and the general contractor for negligence <br />arising from breaches of the following legal duties: <br />• Duty to provide a fence along the canal <br />• Duty to provide a less steep slope of the canal bank <br />• Duty to place a tot lot and sidewalk a greater distance from the canal <br />• Duty to provide a working gate latch for the tot lot perimeter fence <br />• Duty to not allow tenants to move into the development until after safety features were <br />completed <br />The Architect, Engineer and General Contract argued that they had no contractual obligation to work <br />in the canal right -of -way except to construct two head walls for a drainage outfall and shouldn't be <br />included in the suit. They were all kept in the case however and the case settled out of court mid <br />2009.
