An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending <br />Section 212 of the City Code Relating to Construction Site Maintenance Standards; <br />Providing for Severability; Providing for Inclusion in the Code; Providing for Repealer; <br />Providing for an Effective Date. <br />Action: City Clerk Hines read the title, and City Attorney Ottinot reported noting that this <br />ordinance puts a burden on the property owner and also the construction crane operator to <br />remove the crane if no construction activity takes place within a 30 -day time period. If it is <br />not removed we will hold the property owner and crane operator responsible and could be <br />fined $1,000 per day if not removed. <br />Public Speakers: None <br />Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve the <br />proposed ordinance on first reading. They were given the <br />deadline of today to remove the crane, and today we received notice that they contacted the <br />crane owner and they will remove it within two weeks but that is not confirmed. If they don't <br />remove it, he asked the Commission for any action necessary to get that crane down. <br />Mayor Edelcup said one of the other actions that we could take would be to cancel the active <br />permit that is allowing that construction to go forward since they haven't been doing any <br />construction for more than six months, and so he would like the Commission to consider <br />giving the City Attorney the right all the way up to withdrawing the permit if they do not <br />remove the crane in the two -week period. Commissioner Scholl said he would go further, <br />cancel the permit and tear the building down, and he would like to give the City Attorney and <br />City Manager as much leeway as possible, and the Commission agreed. <br />4 <br />
