Commission Minutes: Regular City Commission Meeting February 18, 2010 City of Sunny Isles Beach, Florida <br />inform the public, he feels we are unfairly ticketing them. Commissioner Scholl said the <br />Driver's Manual states "right turn on red in Florida after stop ", and so that is clear, but he <br />agrees with putting up a sign, and he feels we should have a first offense rule to give them a <br />get out of jail free for the first offense and if they get a second offense, they get ticketed. <br />Mayor Edelcup said if we put the sign up, we can do away with the 12 MPH rule, and until <br />such time as we put a sign up, we should not ticket them. Commissioner Goodman said that <br />the sign should say "Stop on Red Before you Make the Right Turn". Vice Mayor Thaler <br />requested that the sign be expedited. Commissioner Scholl asked if we have the software to <br />keep track of the one warning rule, and City Attorney Ottinot said yes, ATS may have a <br />billing based on the license tag. Commissioner Scholl said from this day forward we can <br />send them a warning letter that states this is your one warning, and if you do this again, you <br />are going to get a ticket. <br />City Manager Conner asked for clarification, if we mount the sign do we also give the first <br />one a warning, and Commissioner Scholl said there are three issues here: 1) the Mayor said <br />no tickets until you mount the sign because it is ambiguous; 2) You are going to put the sign <br />up; and 3) When the sign is up, the first ticket is a warning and then you ticket them after the <br />warning. City Attorney Ottinot said we will have to come back and amend our Code for the <br />warning issue, and we will get it to ATS. <br />Commissioner Scholl moved and Vice Mayor Thaler seconded a motion to approve the <br />resolution. Resolution No. 2010 -1530 was adopted by a voice vote of 5 -0 in favor. <br />10F. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving <br />an Additional Software License Agreement with New World Systems, Inc. for the <br />Purchase and Implementation of an Accounts Receivable Module, in a Total Amount <br />Not to Exceed $15,000.00, Attached Hereto as Exhibit "'A'; Authorizing the Mayor to <br />Execute Said Agreement; Authorizing the City Manager to Do All Things Necessary to <br />Effectuate this Resolution; Providing for an Effective Date. <br />Action: City Clerk Hines read the title, and Assistant City Manager /Finance Doug Haag <br />reported noting that $15,000 is a one time fee, and there is an annual cost of $960. <br />Public Speakers: none <br />Commissioner Scholl asked how much invoicing we do, and Mr. Haag said the biggest one <br />coming up is for the Special Assessment billings which are 60 bills a year for 15 years. <br />Mayor Edelcup noted that we will also have some annual billings for TDRs. Mr. Haag said <br />also with the fact that we are landlords we issue rental invoices on a monthly basis. <br />Commissioner Scholl moved and Vice Mayor Thaler seconded a motion to approve the <br />resolution. Resolution No. 2010 -1531 was adopted by a voice vote of 5 -0 in favor. <br />
