The grant of the variance is in harmony with the general intent and purpose of these <br /> LDRs, is not incurious to the neighborhood, or otherwise detrimental to the public <br /> safety and welfare and will not substantially diminish or impair property values within <br /> the vicinity. <br /> All of the variances associated with the Proposed Project are in harmony with the City's <br /> Code and Comprehensive Plan. Approval of the variances will not be injurious or <br /> detrimental to the area or public welfare; and will not impair property values within the <br /> vicinity. <br /> Shoreline Requirements <br /> Because the Property has frontage along Biscayne Bay it is subject to the Shoreline <br /> Development review standards of Chapter 33D, Article Ill of the Miami-Dade County Code of <br /> Ordinances. Although the Proposed Project falls short of the technical requirements of Chapter <br /> 33D, the Applicant is providing a public baywalk across the perimeter of the Property on the <br /> -- - northern and southern-portions-of-the Property-along Biscayne Bay. The baywalk-provides- . - - - <br /> significant connection to the water and connectivity between the baywalks along the northern and <br /> southern portions of the Property, for a meaningful pedestrian and public experience. <br /> The Biscayne Bay Shoreline Development Review Committee approved the Proposed <br /> Project on January 26, 2017. <br /> Request for 36 Months Approval Period <br /> As provided in the proposed estimated construction schedule, Applicant intends to obtain <br /> building permits for all phases of the Proposed Project within 24 months of site plan approval. <br /> However, given the nature of the phased project, and extent of work involved, any minor deviations <br /> (by even one month) would require more than 24 months to obtain building permits for the third <br /> phase. Although Applicant is hopeful to stay on schedule, any minor unforeseen circumstances <br /> would require Applicant to come back to the City Commission for an extension of time. Therefore, <br /> we respectfully request an approval of 36 months to obtain building permits from the date of this <br /> approval, to give Applicant sufficient time to commence and begin construction on all three phases <br /> of construction. <br /> • <br /> • <br /> {40589909;2} <br />
