III. FINDINGS AND CONCLUSIONS: <br /> Based on an analysis of the application and the standards for approval for a site plan application <br /> under the Land Development Regulations, the City Commission makes the following findings and <br /> conclusions: <br /> A. The Applicant's request for approval for a residential condominium tower with north and <br /> a south rental apartment towers, consisting of 127 dwelling units in each tower, a parking <br /> garage of 860 parking spaces, and a remodeled existing tower with 335 dwelling units, is <br /> in compliance with the Land Development Regulations and the Comprehensive Plan of the <br /> City of Sunny Isles Beach. <br /> IV. APPROVALS <br /> A. The Applicant's request for site plan approval for two rental apartment towers of 190 feet <br /> in height with 127 dwelling units each and an enclosed parking garage with 860 parking <br /> spaces is hereby approved subject to all conditions set forth in Section V below. <br /> B. The Applicant's request for a variance to permit building separation to be 33 feet and 7 <br /> inches where 50 feet separation is required is hereby approved subject to all conditions set <br /> forth in Section V below. <br /> C. The Applicant's request for a variance to permit 16 feet and 11 inches to the north garage <br /> side setback where 25 feet side setback is required is hereby approved subject to all <br /> conditions set forth in Section V below. <br /> D. The Applicant's request for a variance to permit 13 feet and 2 inches to the south garage <br /> side setback where 25 feet side setback is required is hereby approved subject to all <br /> conditions set forth in Section V below. <br /> E. The Applicant's request for a variance to permit 3 feet and 2 inches to the north and south <br /> tower porte-cochere side setback where 25 feet side setback is required is hereby approved <br /> subject to all conditions set forth in Section V below. <br /> F. The Applicant's request for the use of graphics and murals on a temporary construction <br /> fencing is hereby approved subject to all conditions set forth in Section V below. <br /> G. The Applicant's request for 12 additional months beyond the 24-month time frame for a <br /> total of 36 months to obtain a building permit is hereby approved subject to all conditions <br /> set forth in Section V below. <br /> V.
