The Agency affirms that it is aware of the provisions of Section 287.134(2)(a), Florida Statutes. An <br /> entity or affiliate who has been placed on the discriminatory vendor list may not submit a bid on a contract to <br /> provide any goods or services to a public entity,may not submit a bid on a contract with a public entity for the <br /> construction or repair of a public building or public work, may not submit bids on leases of real property to a <br /> public entity,may not be awarded or perform work as a contractor,supplier,subcontractor,or consultant under <br /> a contract with any public entity, and may not transact business with any public entity. The Agency further <br /> agrees that it shall not violate Section 287.134(2)(a),.Florida Statutes, and acknowledges and agrees that <br /> placement on the list during the term of this Agreement may result in the termination of this Agreement. <br /> 15.0 ATTORNEY FEES: Unless authorized by law and agreed to in writing by FDOT,FDOT will <br /> not be liable to pay attorney fees, interest, or cost of collection. <br /> 16.0 TRAVEL: There shall be no reimbursement for travel expenses,under this Agreement. <br /> 17.0 PRESERVATION OF REMEDIES: No delay or omission to exercise any right, power, or <br /> remedy accruing to either Party upon breach or default by either Party under this Agreement, will impair any <br /> such right, power or remedy of either Party; nor will such delay or omission be construed as a waiver of any <br /> breach or default or any similar breach or default. <br /> 18.0 AUDIT AND MONITORING REQUIREMENTS: <br /> (a) The administration of resources awarded through the Department to the Agency by <br /> this Agreement may be subject to audits and/or monitoring by the Department.The following requirements do <br /> not limit the.authority of the Department to conduct or arrange for the conduct of additional audits or <br /> evaluations of state financial assistance or limit the authority of any state agency inspector general,the Auditor <br /> General, or any other state official. The Agency shall comply with all audit and audit reporting requirements <br /> as specified below. <br /> 1. In addition to reviews of audits conducted in accordance with Section 215.97,Florida <br /> Statutes, monitoring procedures to monitor the Agency's use of state financial assistance may include but not <br /> be limited to on-site visits by Department staff and/or other procedures including, reviewing any required <br /> performance and financial reports,following up,ensuring corrective action,and issuing management decisions <br /> Page 12 of 23 <br />
