RESOLUTION NO. 2012 - LP0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER NO. 2 TO AGREEMENT WITH TENEX ENTERPRISES, INC. FOR COLLINS AVENUE STREETSCAPE IMPROVEMENTS AND LANDSCAPING SERVICES FOR THE INSTALLATION OF TREES IN THE INTRACOASTAL PARKS, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED EIGHTY THOUSAND THREE HUNDRED NINETY DOLLARS AND THIRTEEN CENTS ($280,390.13), ATTACHED HERETO AS EXHIBIT "A "; APPROVING SIXTY (60) ADDITIONAL DAYS TO COMPLETE THIS WORK; RESCINDING RESOLUTION NO. 2012-1921 ADOPTED ON JUNE 21,2012; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 19th, 2012 the City Commission approved Resolution No. 2012- 1834, awarding RFP No. 11 -11 -03 and authorized the City Manager and City Attorney to enter into an agreement with Tenex Enterprises, Inc. to provide services on a unit price basis for the Collins Avenue Sidewalk Pavers Project, in an amount not to exceed Five Hundred Forty-Six Thousand One Hundred Sixty -One Dollars and Fifty -Cents ($546,161.50), attached hereto as Exhibit "A "; and WHEREAS, on March 1, 2012 via Resolution No. 2012 -1862 the City Commission approved the optional landscaping component to RFP No. 11- 11 -03, to expand the scope of the Collins Avenue (west side) Sidewalk Pavers Project to include enhanced landscaping and fiber optic projects by amending Resolution No. 2012 -1834 increasing the amount from $750,000.00 to $990,000.00; and WHEREAS, on June 21, 2012 via Resolution No. 2012 -1921 the City Commission approved the Second Amendment to an Agreement with Tenex Enterprises, Inc., to add landscaping improvements to Intracoastal Parks, irrigation and electrical work related to the tree up- lights, and for the installation of a meandering walkway in the Parks, in an amount not to exceed Three Hundred Seventy -Two Thousand One Hundred Fifty -Seven Dollars and Thirty-Six Cents ($372,157.36); and WHEREAS, the City now wishes to have the walkway in the Intracoastal Parks constructed in concrete, with in -house crews performing the form work, and now Change Order No. 2 only includes those landscape and lighting improvements directly abutting Collins Avenue in an amount not to exceed Two Hundred Eighty Thousand Three Hundred Ninety Dollars and Thirteen Cents ($280,390.13), and a 60 -day extension to complete the work, attached hereto as Exhibit "A ". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Change Order No. 2 to Agreement. The City Commission hereby approves the Change Order No. 2 to Agreement with Tenex Enterprises for landscape and lighting improvements directly abutting Collins Avenue in the Intracoastal Parks, and a 60 -day extension to R2012- Tenex Change Order and Rescind R2012 -1921 Landscape Intracoastal Pk Page I of 2
