RESOLUTION NO. 2012 - LP0 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER NO. 2 TO <br />AGREEMENT WITH TENEX ENTERPRISES, INC. FOR COLLINS <br />AVENUE STREETSCAPE IMPROVEMENTS AND LANDSCAPING <br />SERVICES FOR THE INSTALLATION OF TREES IN THE <br />INTRACOASTAL PARKS, IN AN AMOUNT NOT TO EXCEED TWO <br />HUNDRED EIGHTY THOUSAND THREE HUNDRED NINETY DOLLARS <br />AND THIRTEEN CENTS ($280,390.13), ATTACHED HERETO AS EXHIBIT <br />"A "; APPROVING SIXTY (60) ADDITIONAL DAYS TO COMPLETE THIS <br />WORK; RESCINDING RESOLUTION NO. 2012-1921 ADOPTED ON JUNE <br />21,2012; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR <br />AN EFFECTIVE DATE. <br />WHEREAS, on January 19th, 2012 the City Commission approved Resolution No. 2012- <br />1834, awarding RFP No. 11 -11 -03 and authorized the City Manager and City Attorney to enter into <br />an agreement with Tenex Enterprises, Inc. to provide services on a unit price basis for the Collins <br />Avenue Sidewalk Pavers Project, in an amount not to exceed Five Hundred Forty-Six Thousand One <br />Hundred Sixty -One Dollars and Fifty -Cents ($546,161.50), attached hereto as Exhibit "A "; and <br />WHEREAS, on March 1, 2012 via Resolution No. 2012 -1862 the City Commission <br />approved the optional landscaping component to RFP No. 11- 11 -03, to expand the scope of the <br />Collins Avenue (west side) Sidewalk Pavers Project to include enhanced landscaping and fiber optic <br />projects by amending Resolution No. 2012 -1834 increasing the amount from $750,000.00 to <br />$990,000.00; and <br />WHEREAS, on June 21, 2012 via Resolution No. 2012 -1921 the City Commission approved <br />the Second Amendment to an Agreement with Tenex Enterprises, Inc., to add landscaping <br />improvements to Intracoastal Parks, irrigation and electrical work related to the tree up- lights, and for <br />the installation of a meandering walkway in the Parks, in an amount not to exceed Three Hundred <br />Seventy -Two Thousand One Hundred Fifty -Seven Dollars and Thirty-Six Cents ($372,157.36); and <br />WHEREAS, the City now wishes to have the walkway in the Intracoastal Parks constructed <br />in concrete, with in -house crews performing the form work, and now Change Order No. 2 only <br />includes those landscape and lighting improvements directly abutting Collins Avenue in an amount <br />not to exceed Two Hundred Eighty Thousand Three Hundred Ninety Dollars and Thirteen Cents <br />($280,390.13), and a 60 -day extension to complete the work, attached hereto as Exhibit "A ". <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Change Order No. 2 to Agreement. The City Commission hereby <br />approves the Change Order No. 2 to Agreement with Tenex Enterprises for landscape and lighting <br />improvements directly abutting Collins Avenue in the Intracoastal Parks, and a 60 -day extension to <br />R2012- Tenex Change Order and Rescind R2012 -1921 Landscape Intracoastal Pk Page I of 2 <br />
