} <br />- h <br />RESOLUTION NO. 2012 - 19-1,rj <br />CFN 2014ROO80020 <br />OR Ek 29013 Pss 1243 - 1245; (3oss) <br />RECORDED 01/31/2014 14:30:32 <br />HARVEY RUVINr CLERK OF COURT <br />MIAMI -DADE COUNTYr FLORIDA <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE <br />TRANSFER OF DEVELOPMENT RIGHTS ( "TDRS ") IN THE <br />AMOUNT OF EIGHTY THREE THOUSAND FOUR HUNDRED <br />AND NINETY (83,490) SQUARE FEET OF FLOOR AREA AND <br />FORTY SIX UNITS (46) TO URBIS AND KEY INTERNATIONAL <br />LLLP FOR THE PROPERTY LOCATED AT 400 SUNNY ISLES <br />BOULEVARD; FROM THE SUB -BANK ACCOUNT OWNED BY <br />URBIS AND KEY INTERNATIONAL LLLP,; DIRECTING THE <br />ZONING ADMINISTRATOR OR DESIGNEE TO TRANSFER <br />THE TDRS FROM THE SUB -BANK ACCOUNT IN <br />ACCORDANCE WITH ZONING RESOLUTION <br />AUTHORIZING THE ADJUSTMENT AND MODIFICATION OF <br />THE TDR SUB -BANK; PROVIDING THE CITY MANAGER <br />WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, by Zoning Resolution No.Y,LZ -13q adopted September 20, 2012, the City <br />Commission approved the zoning application submitted by Urbis and Key International, LLLP <br />(Commonly known as "400 Sunny Isles Beach Marina") for the transfer of TDRS in the amount <br />of 83,490 square feet of floor area and 46 dwelling units; and <br />WHEREAS, by Resolution No. 2006 -1002, adopted October 19, 2006, the City <br />Commission approved the transferring of TDRS, currently owned by Urbis and Key International, <br />LLLP in the amount 83,490 square feet and 46 dwelling units; and <br />WHEREAS, by Resolution No. 2010 -1545, adopted March 18, 2010, the City <br />Commission approved the extension of useful life of development rights owned by Urbis and <br />Key International, LLLP and the Applicant has been paying the annual fees on a timely basis, and <br />WHEREAS, the City's Private TDR Sub -Bank balance will be adjusted to reflect the <br />assignment of TDRS to the Applicant to reflect the reduction of eighty three thousand four <br />hundred and ninety (83,490) square feet of floor area and forty six (46) dwelling units; and <br />WHEREAS, the property receiving the TDRS is described as follows: <br />Parcel 1. Lots 24. 25 and Tracts B, C and D. of Second Revised Plat of Bella Vista Subdivision, <br />according to the Plat thereof, as recorded in Plat Book 50, Page 76, of the Public Records of <br />Miami -Dade County. Florida. (107,010 sq. ft.). 400 Sunny Isles Boulevard. <br />WHEREAS, the City Commission agrees to authorize the transfer of the TDRS <br />contemplated herein in accordance with its transfer of development rights ordinance. <br />Urbis & Key Intemational TDR Bank Page 1 of 3 <br />3 <br />
