Transfer Development Rights <br />The Applicant is requesting to approve the utilization of private's TDRs in the amount of <br />83,490 square feet of development rights and 46 dwelling units. The Applicant owns <br />83,490 square feet of TDRs and 46 units approved under Resolution 2006 -1002. <br />3. Traffic Engineering <br />Traffic Impact Study: <br />To be submitted at building permitting. <br />VI. FINAL ANALYSIS <br />Based on the above review, the application is generally consistent with the City's <br />Comprehensive Plan and the City's Land Development Regulations. As stated <br />previously, this Applicant's project was approved unanimously by the City Commission <br />pursuant to Resolution No. 06 -Z -104, adopted October 19, 2006. The current application <br />is identical to the approved application except for a few minor changes. The minor <br />changes include but are not limited to eliminating requests for a penthouse setback <br />variance and a height variance. The Applicant is also providing a wider bay -walk than <br />that was previously approved under the former application. <br />Staff finds the setback variances requested may be justified due to the depth of the lot <br />and the proposed usage of the structure. Moreover, Staff finds the enclosed commercial <br />marina and use of murals and graphics on temporary construction fencing is warranted. <br />At this time, City Staff has no objection to the Applicant's requests. <br />VII. CONDITIONS <br />If the City approves this application, the application will be subject to the following <br />conditions set forth in Section VII. <br />Conditions to be completed before demolition, below grade or building permits are <br />issued. <br />1. If applicable, a Miami -Dade County tree removal permit must be secured and attached to <br />the landscape permit application prior to demolition. <br />2. Palms along Sunny Isles Boulevard must be at least 12' clear -wood Medjool Palms to be <br />consistent with the City Streetscape Master Plan. <br />3.
