These plans and <br />this Project were originally and unanimously approved on October 19, 2006 by Resolution 06 -Z -104. <br />Unfortunately, the real estate market turned and the project lay fallow although the TDRs purchased for <br />this project have been renewed each year since. We are happy to report the Applicant has accepted <br />reservations, subject to site plan approval by the City, on a majority of the units, and is now ready to <br />proceed. The plans have been updated to comply with any code changes both within the City, Miami - <br />Dade County Fire and the most recent Florida Building Code. In all other respects, the Project remains <br />identical to the original plans. The only exception in terms of the design is the addition of balconies <br />to four townhomes. The plans have also been amended to reflect changes required by today's <br />updated building, zoning, and fire codes. Once approved, the marina site will shortly be turned into the <br />beautiful gateway project the City deserves and will complement in every way the new Gateway Park <br />currently under construction and the balance of the streetscape plan for Sunny Isles Boulevard. <br />This enclosed updated Application requests a site plan approval with two minor variances <br />customarily granted on the South edge of Sunny Isles Blvd but otherwise meets or exceed all <br />requirements of the District, a request for use of TDRs, a request for approval of a conditional use to <br />permit an enclosed marina for use by the unit owners of the condominium as well as a certain percentage <br />of outside guests, and, finally, a request for use of graphics on a temporary construction fence. This <br />application is being submitted herewith for the City Commission's consideration. <br />The Marina Property consists of a 2.457 acre site located in the City's Town Center Sunny Isles <br />Blvd South Edge District. It meets or exceeds all requirements of this District, the criteria for all <br />requested bonuses (covered garage and mixed use) and is requesting less than the permissible amount of <br />TDRs (less than 30 %) and less than the amount of square footage attributable to the FAR per Section <br />265 -37 of the City's Land Development Regulations. <br />Agenda Item No.6A \nDate 9/20/2012 <br />38 <br />
