Attachment number 4 \nPage 15 of <br />SUNNY it,° <br />1 7 <br />CITY OF SUNNY ISLES BEACH <br />y1 C. �e flOR` Oti <br />HOLD HARMLESS AGREEMENT <br />M <br />Applicant: Urbis & Key International, LLP <br />In conformity with the requirements set forth in Section 265 -11 of the Code of <br />Ordinances of the City of Sunny Isles Beach, all applications for approval of a <br />development permit may only be filed by the fee simple owner of the land affected by the <br />development permit, or a contract purchaser, or lessee, if applicable, of said land <br />authorized by the fee simple owner, to file such an application. The requirements further <br />require that the applications be notarized by a public notary in the State of Florida. <br />In the instant case, the Applicant Urbis & Key International, LLP (the "Applicant ") has <br />submitted an application for approval of a development permit for the property located at <br />400 Sunny Isles Blvd, Sunny Isles Beach Florida 33160 (the "Property. "). However, the <br />applicant's application is notarized by a public notary who resides outside the state of <br />Florida. In consideration of the City's acceptance of the Applicant's application <br />notarized by a public notary located outside the state of Florida, the Applicant agrees to <br />defend, indemnify and hold the City, its directors, officers and employees harmless from <br />any claims, liabilities and causes of action arising out of the negligence, error, omission, <br />or intentional acts of the Applicant's public notary, in connection with the application for <br />approval of a development permit submitted by the Applicant. <br />Each party has read and fully understands the terms of this Hold Harmless Agreement. <br />By signing below, each party represents they have full authority to enter into this Hold <br />Harmless Agreement. Nothing herein shall be construed to affect in any way the City's <br />rights, privileges, and immunities under Section 768.28, Florida Statutes. <br />Witness (sign and print name) <br />n M.
